A policeman under investigation for alleged links to the illegal drug trade was killed in an ambush as he was driving his sport utility vehicle in Quezon City on Wednesday night. 

Police Officer 3 Rufino Gabis, 47, was at a stoplight along Kalayaan Avenue in Barangay Malaya when two men on a motorcycle attacked him at around 8 p.m., probers said. 

The backrider got off the motorcycle and fired shots through the driver’s side window of Gabis’ new Toyota Fortuner. Gabis died at the scene as the assailants sped away. 

Chief Superintendent Joselito Esquivel, QCPD director, said Gabis was “relieved” from his post at the Kamuning police station months ago following “reports of impropriety.” 

Esquivel added that there is no final report yet on Gabis’ alleged drug links.
This officer was relieved from duty months ago and the PNP still do not have a final report on his alleged drug links. Why not? Is someone preventing an investigation to be completed? Or is the PNP just that slow?

“Don’t kill the street pushers; arrest them. Make them lead you to the big-time suppliers, then finish the job by engaging those suppliers in a shootout,” said Lacson, a former PNP chief. 
The law enforcers could then repeat the cycle by arresting another street pusher and finding his source of illegal drugs, he added.
"Finish the job by engaging those suppliers in a shootout"??? Is this Senator, a former PNP chief, really telling the PNP to actively engage suspects in a shootout and kill them? Yes he is. Is that not the essence of an EJK? To kill suspects? He also seems to forget that there have been no suppliers caught. Even Peter Lim is still on the run! It's all small time dealers and users who have been the casualties in the drug war.

Duterte led the distribution of 623 land ownership certificates to 484 agrarian reform beneficiaries for the 274 hectares of government-owned lots in Boracay and two towns in Aklan province. 
Specifically, the government turned over 3.2 hectares to 45 beneficiaries belonging to the Boracay Ati Tribal Organization based in Barangay Manoc-Manoc in Malay, Aklan.The rest of the beneficiaries were from Barangay Kabulihan in Malay town, Barangay Nazareth in Buruanga, Aklan and Barangay Tagas in Tangalan, Aklan.
In his speech, Duterte reiterated that the beneficiaries could sell their lots to commercial developers once the 10-year prohibition on selling the property has lapsed.  
Under the Comprehensive Agrarian Reform Program (CARP), the agrarian reform beneficiary cannot sell, mortgage and encumber his property during 10 years from award. 
"In the meantime, till the land, make it productive and when the prohibition period is over, maybe your children can sell it and it would be million[s]. May mga Ati dito na yayaman balang araw," he said.
The CARP is also known as R.A. 6657 which was amended by R.A. 9700. Here is the text of the law on transferring or selling land under the CARP.
"SEC. 27. Transferability of Awarded Lands. - Lands acquired by beneficiaries under this Act or other agrarian reform laws shall not be sold, transferred or conveyed except through hereditary succession, or to the government, or to the LBP, or to other qualified beneficiaries through the DAR for a period of ten (10) years: Providedhowever, That the children or the spouse of the transferor shall have a right to repurchase the land from the government or LBP within a period of two (2) years. Due notice of the availability of the land shall be given by the LBP to the BARC of the barangay where the land is situated. The PARCCOM, as herein provided, shall, in turn, be given due notice thereof by the BARC.

Duterte is telling these people they can sell their lands after 10 years to commercial developers. But the wording of the law does not allow for that.

She will undoubtedly appeal to the Supreme Court. It's hard to believe she will spend even a single day in prison.

The CITF is the police unit tasked to run after erring officers.

Mr. Duterte on Tuesday offered a trip to Hong Kong as reward to the policeman who killed Supt. Santiago Rapiz in a drug buy-bust in Dipolog City, Zamboanga del Norte. 
Two days later, Cariaso was shot as he alighted his sports utility vehicle. Cariaso is said to be assigned at the PNP’s Internal Affairs Service (IAS) in Camp Crame. The PNP-IAS handles complaints against policemen. 
Albayalde said policemen are “concerned” about the attack on Cariaso since it could be an indication that some senior officers in the PNP could still be involved in the illegal drugs trade.
Funny how Duterte's words are always stripped of their power by his subordinates. His words are either reduced to a joke or they are dismissed with a wave of the hand.

Is the new head of the Bureau of Corrections (BuCor) missing in action? 
According to Justice Secretary Menardo Guevarra, recently installed BuCor chief Nicanor Faeldon “has not showed up or said anything.” 
“I have no idea why. I have mentioned this fact to the Executive Secretary during the Cabinet meeting last Tuesday. He said he would mention it to the President,” Guevarra said Friday.

Sen. Cynthia Villar told DWIZ on Saturday, noting it was Imee Marcos’ birthday on Nov. 10, when former First Lady Imelda Marcos was found guilty of graft charges.

When asked if the conviction of Imelda affected Imee Marcos’ candidacy in the 2019 senate elections, Senator Cynthia Villar claimed: “Wala naman [It does not have an effect].”
Hahahahaha!!! Oh man! But guess what! Imelda skipped her court date and showed up at Imee's birthday party and pictures of that event circulated on social media angering a lot of people. So it turns out Imelda's conviction didn't put paper on the her daughter's birthday at all. Amazingly there are some who think Imelda should not pay the penalty for her crimes.

But placing Imelda, an octogenarian, behind bars would do the country no good, according to House Deputy Minority Leader Danilo Suarez. 
Suarez, a Quezon representative, said the proposals to exempt Imelda from serving the 77-year jail term handed down by the antigraft court Sandiganbayan were reasonable considering her age. 
“For us to have closure, don’t make this a big issue,” Suarez told reporters. “If you have her arrested, the issue will only become bigger.” 
In the House of Representatives, Suarez said critics of the late dictator had done nothing but look for the wrong that Marcos had done. 
“How about the good things they [Marcoses] had done?” the lawmaker said. 
Suarez said the country would not move on if people would dig up the past.
It's a mentality like this, that people should not have to pay for their crimes or that making someone pay for their crimes means digging up and dwelling on the past and not moving on, that makes the political and legal culture in the Philippines such a nightmare of impunity. And this guy is a lawmaker!

In a radio interview, Igwas said he was forced to take a horse to work because Kidapawan Mayor Joseph Evangelista, in a memorandum, had stripped him of his service vehicle for allegedly refusing to support the mayor’s candidacy. 
He was singled out, Igwas said, “because there were reports I was supporting another mayoral candidate,” Vice Mayor Bernardo Piñol Jr. 
Igwas maintained he was “not supporting any politician because that is not allowed by law. As IPMR (representative), I’m supposed to be apolitical.” 
On Oct. 28, Evangelista sent another memorandum to Igwas telling him to vacate his office because it would be converted into the Office of the Deputy Mayor for Indigenous Peoples (IP). 
In a DXND radio interview, the mayor admitted ordering the recall of Igwas’ service vehicle and asking him to vacate his office, but stressed that there was “no politics” involved in those actions. 
Citing a letter that Igwas wrote him in February, Evangelista said the IPMR actually asked for funds from the local government for his office’s renovation. 
Igwas’ office, the mayor explained, will be turned into a livelihood training center for IP women and will be called Kidapawan City Tribal Hall and Training Center. 
As for Igwas’ service vehicle, Evangelista said it was aging and needed repairs, hence it was recalled. 
But Igwas said these were not the reasons given him when the vehicle was taken and he was evicted from his office. 
“The vehicle was recalled [supposedly] for the use of the city engineering, and the office for the use of the deputy mayor for IP,” Igwas said. “I guess I was stripped of these because there are things I would not do, jobs I simply cannot do because these are not within my mandate.”
Does he have a bag on that horse or does it mess everywhere in town? Where does he tie up his horse when he gets to town?

He cited among the country’s diplomatic successes the handling of the West Philippine Sea dispute, mainly with China; the country’s reelection to the United Nations Human Rights Council despite some nations’ outcry against Mr. Duterte’s war on drugs; and the international cooperation to rehabilitate Marawi City.
Nothing in that list is a diplomatic success. China continues to ignore the 2016 UN ruling and to be aggressive in the WPS, the Philippines being elected to the UNCHR was due to there being no one else and is not an affirmation of Duterte's policies, and international cooperation to rebuild Marawi is not necessarily a good thing. It's fine to accept the money donated from foreign nations for the purpose but to have a Chinese construction company lead the rebuilding instead of a Filipino company is only going to cause complications.
President Rodrigo Duterte warned that the national government would take over facilities of Palawan’s lone power distributor and bring in a foreign company if recurring outages did not end. 
“On the extreme, maybe I will give you about toward the end of the year [to have] a new set-up that would provide enough energy so that it can operate and it can move,” the President said in a rambling hour-long speech at People’s Amphitheater in Mendoza Park. 
“You have to upgrade your source of energy. If not, I will find one with funding — China has been itching to get hold of developments here,” Duterte said.
And Duterte is eager to give China any foothold in the Philippines they want.

Police chief Director General Oscar Albayalde on Monday said that they were looking into the links of some politicians to private armed groups (PAGs) in preparation for the 2019 midterm elections. 
“We cannot divulge the name of those politicians, but we have intelligence information that needs to be confirmed and validated.  Hindi lang natin basta-basta masabi ‘yung pangalan ng politko,” he said in a press briefing at Camp Crame. 
Despite this, Albayalde noted that known PAGs, especially in Northern, Central, and Southern Luzon, had politicians as clients. 
“Dun sa mga lugar na ‘yon, there are reports that they are being used especially during election time. Basically, ang information that we gather are mostly governors and mayors ‘yung mga candidates,” he said. 
He cited a certain “Peralta group,” which he said had been used by some politicians in the past.
Politicians hiring armed groups. That's Philippine politics! The PNP says this every election though so nothing new here sadly.

The National Bureau of Investigation (NBI) yesterday filed graft charges against former Customs commissioner and now Technical Education and Skills Development Authority (Tesda) chief Isidro Lapeña over 105 shipping containers that are missing and believed to contain undervalued goods.  
In the complaint filed before the Department of Justice, a copy of which was obtained by The STAR, NBI probers said Lapeña failed to issue a “special stop order” against the release of the undervalued items from the Asian Terminals Inc. (ATI).
Finally a big fish has been caught. But it's possible he could wiggle away.

Gatchalian on Tuesday noted an April Jobstreet Philippines survey which found that only 24 percent of local employers are willing to hire K-12 graduates. 
In July, DepEd Secretary Leonor Briones said the agency will review the program after two years of its implementation. Initial results are expected to be released around February next year.
The K-12 program was only implemented two years ago so there is no way any real assessment can be made.  They would have to wait at least twelve years or more to get a real assessment. That anyone is questioning K-12 schooling, which is a standard used worldwide, is an admission that the Philippines education system is subpar. In the Philippines employers, ALL EMPLOYERS, want college graduates.  That includes McDonald's burger flippers and SM cashiers! And usually they all have the same worthless degree in tourism or hotel management.

The National Bureau of Investigation (NBI) has filed graft and malversation charges against 24 local officials of Aklan, including the governor and vice governor, as well as the mayor and vice mayor of Malay town in connection with the alleged misuse of P84 million in Boracay funds.  
In a complaint dated Oct. 22, a copy of which was obtained by The STAR yesterday, NBI Director Dante Gierran submitted to Ombudsman Samuel Martires the results of their investigation into the alleged misuse of millions of pesos in environmental and admission fees (EAF) collected from tourists entering Boracay. 
The fund was supposed to be allocated for the preservation of the island. ?Investigation showed the local government of Malay used the EAF to fund other projects like the solid waste management program of the entire municipality, which is composed of 17 barangays. 
The EAF was supposed to be used only for the waste management program for three barangays located in Boracay. ?“The purpose of the collection was for the sustenance of the island of Boracay. It was compromised and violated when the mayor, treasurer, vice mayor and members of the Sangguniang Bayan of Malay allocated the EAF for the entire municipality,” the complaint read.
Funds were misused by being spent on solid waste management?? That's a new one! At least they were using the money for something positive and not just lining their pockets.

Former Vice President Jejomar Binay on Wednesday said he wants a review of the power of  Congress to conduct investigations, as he lamented that some inquiries touch on personal matters. 
Section 21, Article VI of the 1987 Constitution states that the “Senate or the House of Representatives or any of its respective committees may conduct inquiries in aid of legislation in accordance with its duly published rules of procedures.” 
Binay, who is seeking election as Makati City’s First District Representative in 2019, said that the phrase “in aid of legislation” is too general. 
(I will convince my future colleagues in the Congress to review the investigation powers of Congress to determine its extent.)

If Binay gets elected he will hold and investigation into investigations conducted by Congress. Now that sounds good since the Senate has investigated crimes like the Ateno hazing incident. But the key here is him saying investigations can become too personal. He is certainly referring to himself.

The subcommittee earlier released its partial report on its investigation, which recommended the filing of plunder and other criminal charges against those involved in the alleged overpriced Makati City Hall 2 parking building. 
In particular, the body recommended the filing of plunder and graft charges against Binay, who was the mayor of Makati City before he became Vice President.
Charges were filed against Binary and he and his family were even told by the COA to return P2.29 billion! Who would vote for this man? Why would the Comelec allow him to run?

The Philippines will remind China that it has a mutual defense treaty with the United States, a complication in the dynamics between Association of Southeast Asian Nations (ASEAN) member countries and China. 
President Rodrigo Duterte, in an ambush interview with reporters before the start of the ASEAN-China Summit on Wednesday, said he will press for the conclusion of negotiations for a code of conduct (COC) in the disputed South China Sea during the meeting between Southeast Asian leaders and Chinese Premier Li Keqiang in Singapore.
The COC can dictate manners by which countries can deal with each other. 
“It’s [mutual defense treaty] not been abrogated. It’s there and even I don’t know [if] it's the decision of the President, Congress, the Armed Forces,” he said. 
“Yes, I will focus on the COC. Everything has been excellent between China and the rest of the ASEAN except for the fact that there’s friction between the western nations and China," he said. 
Duterte then mentioned the 1951 Mutual Defense Treaty between the Philippines and the US that obliges American troops to help defend the Philippines if it comes under attack. 
"And I am worried and I expressed it last night because we have a defense treaty, mutual defense treaty with the US,” he added. 
The President seemed to suggest that the Philippines may be in a bind if there are conflicts in the South China Sea or the West Philippine Sea, the name the Philippines calls that part of the ocean where it has claims. 
“[If]…there’s some serious miscalculation can…you know and because of the treaty I'd like to [tell] China that is why at all cost we must have the COC. So you’re there, you’re in possession, you occupied it, then tell us what route shall we take and what kind of behavior do you want,” he said.
There is a lot going on here. It sounds like Duterte is worried China might do something stupid and the USA would take that as an opportunity to enforce the mutual defence treaty and attack China. It also sounds like Duterte would gladly abrogate this treaty if he could. Just more evidence of Duterte's love for China but what about when he is gone?  Will his successor enforce the mutual defect treaty?

The daughter of President Rodrigo Duterte has raised the hands of rival mayoral candidates in Pasay City, prompting supporters of both Chet Cuneta and Emi Calixto-Rubiano to argue online as regards Sara Duterte's real choice.
This is stupid.  She is hedging her bets by endorsing both candidates!

Albayalde said the PNP would write a letter listing the concerns of the police about the show to the Movie and Television Review and Classification Board (MTRCB) 
But ABS-CBN said in a statement that the program was “purely fictitious,” as it had always stated in a disclaimer at the start of the show. 
“FPJ’s Ang Probinsyano” assures the Philippine National Police (PNP) that the characters, places, and incidents in the program are purely fictitious as stated in the disclaimer aired at the start of the show every night,” ABS-CBN said.
This is funny because Bato praised Ang Probinsyano for being a good portrayal of the PNP and even met with Coco Martin. Also the PNP has a working relationship with the media to portray them in a good light. You can read about that relationship here.  It's also funny because officers who rape, extort, and outright murder citizens is what really gives the public a bad impression of cops.

“I said China is already in possession. It’s now in their hands. So why do you have to create frictions, strong military activity that will prompt a response from China?” he said. 
“I do not mind everybody going to war, except that the Philippines is just beside those islands. And if there’s a shooting there, my country will be the first to suffer. That is my only national interest there. Nothing else,” he said.

In a press briefing here, Foreign Affairs Secretary Teodoro Locsin Jr. initially did not want to comment on Duterte’s remark because he was not present when the President issued the statement to reporters in an ambush interview. 

But Locsin, who assumed his post as the country’s top diplomat in October, said the Philippines was not surrendering its claims to China in the West Philippine Sea. 

“Absolutely not. I have repeatedly said not an inch, not an iota of sovereignty. That was my, I keep saying it, I said it also in the UN (United Nations),” he said in a press briefing here.
Teddy Boy is going to have to start coordinating with Duterte to make sure he says nothing to contradict Duterte.

Amazing to see the difference between the way the DOJ is taking a hands off approach with Lapeña and the PNP is hesitant to arrest Imelda should a warrant come with the way Trillanes was handled. There were officers stationed outside the Senate ready to arrest him at a moment's notice and the PNP even said they had a cell prepared for him! The DOJ venue shopped until they got the arrest warrant they wanted. Are there officers hanging around outside Imelda's house waiting to swoop in for the arrest? No. Is the DOJ actively pursing the NBI's recommendations against Lapeña? No.

Loud Music Transforms SaveMore Into a War Zone

How is anyone supposed to enjoy shopping when SaveMore has the volume on the music turned all the way up!?  Look at this beast:


Those two speakers are pumping out a BOOM-BOOM-BOOM jam that is so loud your body is shaking as you pass by and what is the point even?  Because there is a sale? How about just give me a flyer with all the sale items listed. As it is all I hear is loud music and I don't see a single item for sale.

When you walk in you are greeted with another set of loud club music coming from speakers overhead. So now there are two different sets of loud music blasting at customers as they come in and as they stroll about.

If that's not enough over in the non-food department they have this little but powerful monster blasting even more jams:


What is the point? Is this thing for sale? Were there some items for sale on that platform? If they are all gone why is this music continuing to play? All the idle grocery clerks were sure enjoying the jam as they stood around nodding their head to the beat.

So now there are three sets of loud, unnecessary, rude, aggressive, bassy, club music shouting at you as you walk around the store and all you really want to do is get your items and get the heck out where it's nice and quiet. SaveMore gives you no time for strolling or window shopping. It's a war zone and if you don't know what you need and exactly where it's at you will be caught in the cross fire of all those speakers blasting out their angry sound waves.

This loud, aggressive club music blaring in your ears as you walk about the store is unnecessary and uncomfortable and out of place. Who really wants to hear all this noise this when they are out doing their shopping? Anyone? As I was leaving an old man was walking into the store holding his ears and with his shoulders shrugged up to his neck and he was shouting something to the guard which I couldn't understand because of the loud music but was undoubtedly something like, "Why is that music so loud!?"

The Fil-Am Bomber

By now the whole world knows that the alleged mail bomber in the USA is a Filipino-American.

Yeah that's him. If you don't know the full story let me give you a run down. Caesar Sayoc is a homeless, living-in-a-van-down-by-the-shopping-centre, bodybuilder, DJ, stripper, pizza delivery guy, who allegedly sent fake bombs to various liberals and media organisations. He is also "a foot soldier for white supremacy" despite not being a white man in the slightest bit.

Cesar Sayoc is also a man with a Filipino father and an Italian mother. He is apparently a very unstable and crazy man with a criminal past. 
His attorney in that 2002 case, Ronald Lowy, described Sayoc as “a confused man who had trouble controlling his emotions.” 
A cousin of Sayoc, Lenny Altieri, used stronger terms. 
I know the guy is a lunatic,” Altieri told The Associated Press. “He has been a loner.”

Remarkably enough he shares all those traits with another well-known Fil-Am, Andrew Cunanan.


Andrew Phillip Cunanan (31 August 1969 – 23 July 1997) was an American spree killer who murdered at least five people, including Italian fashion designer Gianni Versace and Chicago real estate developer Lee Miglin, during a three-month period in mid-1997. Cunanan's string of murders ended on July 23 with his suicide by firearm. He was 27 years old. 
In his final years, Cunanan had lived without a job, befriending wealthy older men and spending their money to impress acquaintances in the local gay community, by boasting about social events at clubs and often paying the check at restaurants. One millionaire friend had broken up with Cunanan in 1996, the prior year. 
Andrew Phillip Cunanan was born August 31, 1969, in National City, California, to Modesto "Pete" Cunanan, a Filipino American,[4] and Mary Anne Schillaci, an Italian American, the youngest of four children.
Both of these men had Filipino fathers and Italian mothers. Both were crazy. And both lived in Florida.

Florida Man is an Internet meme, popularized in 2013, in which the phrase “Florida Man” is interpreted as the name of the same individual in multiple unrelated news articles, rather than a description of various actual men who hail from or live in Florida. Internet users typically submit links to news stories and articles about unusual or strange crimes or events occurring in Florida, particularly those where "Florida Man" is mentioned in the headline and has been wreaking havoc. The meme calls attention to Florida's supposed notoriety for strange and unusual activity.
Or is it miscegenation? The mixing of a Filipino male and an Italian female? 

Could it be that a Filipino male/Italian female mix is bad news? Does the child get the worst of both worlds? Do the psychological traits of both the Filipino and Italian degenerate into something unstable?

Whatever the connection here is it sure is interesting to see that two Filipino/Italian mixed breeds living in Florida turned out to be crazy persons.

Martial Law: Extreme Measure

We are now only a month away from when Duterte will inevitably ask Congress to extend martial law for another year. Between now and then various officials will come out saying why they are in favour of such an extension. Let's take a look at a few who have already voiced their opinion and pick them apart. Each person is basically saying the same thing so be warned this might get redundant.

Keep in mind what the constitution gives as reasons for declaring martial law:
The President shall be the Commander-in-Chief of all armed forces of the Philippines and whenever it becomes necessary, he may call out such armed forces to prevent or suppress lawless violence, invasion or rebellion. In case of invasion or rebellion, when the public safety requires it, he may, for a period not exceeding sixty days, suspend the privilege of the writ of habeas corpus or place the Philippines or any part thereof under martial law.

The phrase "when the public safety requires it" should equivocate with the phrase "to prevent or suppress lawless violence" in the previous sentence.

"If they ask the opinion of the PNP, if ever that they will ask for the agency's position, we will support the extension, especially with the incoming elections. Mas maganda 'yan (That's better)," Albayalde said in a press conference. 
Defense Secretary Delfin Lorenzana earlier told reporters that the police and military have the entire November to monitor threats and ask Mindanaoans for their view on prolonging military rule. 
It appears that the PNP had already completed its own probe into Mindanao. Aside from the upcoming elections as a reason, during the briefing, Albayalde said in Filipino, "We got information, not on an actual survey, but based on the public, they want martial law in Mindanao." 
Lorenzana himself earlier flagged martial law as an "extreme measure" that should not be conditioned as necessary for the safety of Mindanaoans. 
"It's because martial law is like the last, the extreme measure that the government uses. I think it should not be used lightly if we don't need to use it," Lorenzana said during a House of Representatives budget briefing of his department last August.
The Chief of the PNP gives as reasons for extending marital law the safety of the upcoming elections and the fact that Mindanaoans want martial law. Neither of those reasons are constitutional. If Albayalde thinks there is so much lawless violence which needs suppressing or preventing safeguard the elections and the people then he should have come out and said that. But he did not.

Lorenzana is more cautious about the matter and that is good. Martial law is an "extreme measure" which should not be touted as a safety measure for Mindanao when it is not required.

"We still would like to think that the extension of martial law should be on a last-resort basis.... It is an instrument for us that will be considered as a last resort, but if it is needed, as dictated by the situation and the desire of the people, then so be it. Susundin natin 'yun (We will follow that)," Esperon said. 
Esperon has not yet recommended an extension, unlike Interior and Local Government Secretary Eduardo Año and Philippine National Police (PNP) chief Director General Oscar Albayalde. The national security adviser said he wants a comprehensive study on the sentiment of Mindanaoans on martial law extension and state of security to be completed first. 
Esperon, who was also a presidential adviser on the peace process, disclosed that, from what he had been hearing, "majority of Mindanaoans" favor another extension.
Esperon, like Albayalde, thinks an extension of martial law must be based on the desire of the people. He also says he wants a comprehensive study on the "state of security" before he makes any recommendations. Most people are probably like Esperon in that they have been hearing that a majority of Mindananoans want martial law. In fact that is what the government keeps repeating again and again and again. But where are the surveys? Have there been any? Has the AFP or PNP gone door-to-door asking if people want another martial law extension? That scenario is highly doubtful.

The uneasy "state of security" is not an unwarranted reason to declare martial law. If there is lawless violence and the security of the state and people are at risk then that is a valid reason to declare marital law. The desire of the people is not a valid reason. And not all Mindanaoans are in favour of another extension.

Marawi civic leader and senatorial aspirant Samira Gutoc is opposing a 3rd extension of the martial law in Mindanao, saying martial rule in the southern island has not addressed basic human dignity issues in the southern island. 
Nakita natin (We can see that) after 17 months of Marawi that there is still not food accessible for the poorest, there’s still missing people, there [are] children who are still hospitalized. It doesn’t say that martial law has fully addressed basic human dignity issues,” said Gutoc. 
“You don’t need martial law ruling. Hindi ka araw-araw may martial law (You don’t need martial law every day),” she added. 
The Liberal Party’s senatorial bet believes people-centered movements, not another martial law extension, would help bring about peace in Mindanao. 
“Peace movements are grassroots. Definitely we work with the church, we work with grassroots leaders and movements of masses across Mindanao… As LGUs (local government units), tayong mga mayors (as mayors), are we giving up power? As congressmen, are we giving up power to suppress rebellion within our communities?” asked Gutoc.  
Nasa atin ‘yon eh. Nasa ating karapatan (It’s in us. It is part of our rights) – the will to walk the streets and stop criminals, talk to emissaries and liaison people to stop terrorism, stop the kids who are thinking this way. Importante ‘yon eh (That’s important). You don’t give up power, because that’s what martial law says. You’re giving it up for national implementation,” she added. 
“I would say that this administration has to recommit to the fundamental precepts of what Mindanao stands for, which is interfaith, solidarity and peace. Very important po 'yan (That’s important). You cannot escape from faith, from respecting human life,” said Gutoc.
Does this gobbledygook even require a response? Martial law is not supposed to address human dignity issues or put food on people's tables or find missing people. It is to stop an invasion, rebellion, or suppress or prevent lawless violence. This lady is opposing an extension for all the wrong reasons.

“Based on the feedback of the people of Mindanao, I would rather opt for another extension,” he told reporters in a chance interview.
Again what is this feedback? From LGU's?  From business owners? From poor farmers and shanty dwellers? Who is giving the feedback and how did they give it? Still not a valid reason to extend martial law.

Now for the last recommendation. This one is from the AFP Chief.

Are you surprised that the AFP Chief did not give a constitutionally valid reason for extending martial law?

None of these recommendations are formal. The AFP still has to assess the situation on the ground.

What kind of assessment is the AFP in need of making? Do they not know the state of Mindanao? The underlying assumption, which no one has the guts to say out loud, is that Mindanao is in a perpetual state of lawless violence which threatens the security of the state and the people and marital law is a stop-gap measure holding back a river of blood. If such assessment is true why not just say that?  Why not just tell the people about the numerous armed groups and petty and violent criminals causing terror in Mindanao?

But is it even true? Is Mindanao in a perpetual state of lawless violence? DND Sec. Lorenzana has said the NPA will be defeated by Q2 2019. The AFP says that Maute remnants have lost the will to fight. Huge numbers of terrorists are allegedly surrendering.

Duterte is even willing to give the NPA land!

“Do not confiscate or seize or occupy the lands that are already owned. Don’t do that. Don’t steal lands that already have tenants,” he said. 

Let’s talk. I’ll give you land. What will I do with those anyway? It’s not mine. I told Secretary [Castriciones] to distribute government-owned lands tomorrow...the lands that weren’t included as reservation for schools,” he said.
Every indication from the government is that Mindanao is safer than ever as a result of martial law and that there is no widespread lawless violence.

A second year of martial law in parts of the Philippines is squelching any comeback by violent Muslim insurgents after a civil war, despite earlier fears that the order would also curb common people’s freedoms, witnesses say. 
A network of road checkpoints outside major cities, permission for authorities to frisk people without warrants and evening-to-morning curfews have helped troops throttle further violence by Muslim rebels without routine harassment of common people, said Eduardo Araral, a Mindanao native and associate professor at the National University of Singapore’s public policy school. 
“That (law) could slow down the plans of the terrorists or even small wildcat operations,” he said. “They couldn’t just enter the cities without being frisked at the borders by the military, and they needed martial law for that,” he said. “So, I think it also calmed down the nerves of the city residents. My relatives who live in Mindanao are very happy with this.” 
Martial law in Mindanao has restricted the movement of armed rebels, including possible Islamic State operatives, largely by keeping them out of the cities. Cities in turn empty after dark because of the curfews. 
Rural military and police outposts established under martial law are freer now to track rebel movement by stopping and interrogating suspects. 
Martial law is widely accepted for now as a tool for squelching rebels as well as the illegal drug trade, said Habib Macaayong, president of the Mindanao State University system based in Marawi. 
“Martial law is very helpful because it is an instrument for controlling various elements, and it is very good for the meantime,” he said.
It's a catch-22 situation. Martial law has tamed the lawless violence in Mindanao to a large degree. There is still violence to be sure. Foreign fighters are still looking to join the jihad in Mindanao. Petty and violent crimes have plummeted. But if martial law were to be lifted the floodgates would open up again and all the armed groups would be freer to move around and commit violence. Common criminals would be able to prowl the streets for prey once more. Murders and rape would sky rocket. Anyone with a bit of sense knows this is true. The Muslims in Mindanao cannot contain their violent lusts. That is simply a fact of life.

So why won't the government just come out and say that? Why can't they just be honest about the situation and tell is like it is? Why prevaricate and talk about safeguarding elections and the will of the people and not talk about the violence in Mindanao? Why not just come out and tell the truth?

But on the other hand before the Marawi siege there was no martial law despite the widespread lawless violence in Mindanao. The Marawi siege was the reason martial law was declared and now the siege is over. Mindanao is back to where it was before the siege which is a relatively violent place that is not so violent people can't attend school or shop at the mall or where a Canadian can't live and try to convince everyone that Mindanao is safe but is violent enough for countries to issue travel warnings for Mindanao.

What is the solution?

Duterte has already given the solution when in September 2016 he declared the entire nation in a state of lawlessness. That means a heavy military presence and checkpoints without the suspension of habeas corpus. It's martial law lite one could say.

Of course even this proclamation is open to abuse as seen in the AFP's takeover of the BOC which was based on this declaration of lawless violence.

Don't Play in the Road

This story is incredible. Just read it.

“Drying of palay and other farm produce along national highways is totally banned in order to safeguard the motorists from any untoward incident,” the agency said. 
The directive, according to the DPWH, is pursuant to DPWH Department Order No.41, series of 2013 and DPWH Department Order No. 52, series of 2003, and pursuant to provisions of Section 23 of Presidential Decree No. 17, stating that “It shall be unlawful for any person to usurp any portion of a right-of-way, to convert any part of any public highways, bridge, wharf or trail to his own private use or to obstruct in the same in any manner.” 
Violation of the law is punishable by a fine of not more than P1,000 or by imprisonment not exceeding to six months. 
Based on the department order issued in February 2003, the private use of even the sidewalk, gutter and curb, or any other portions of the road covered by the right-of-way is prohibited. 
Private-owned structures installed on the road right-of-way are also banned. This is usually the case on the national roads in the metropolis. 
According to the same department order, all kinds of private temporary and permanent structures such as buildings, houses, shanties, stores, shops, stalls, posts, canopies, billboards, signages, advertisements, fences, walls, railings, basketball courts, and garbage receptacles. 
Plants and plant boxes are also prohibited along the national roads. It is also not allowed to use any part of the national road as a storage area for construction materials. Using it as a parking lot and for repair shops are banned.
I don't live near any national highways. Just normal roads which are always busy and are always cluttered.

Cluttered with electrical poles and parked cars and food stalls and grills and repair shops and restaurants and basketball courts. Cluttered so much that traffic gets stuck and slowed down. Even houses and shanties are right on the edge of the road. There is literally no space between the road and many shanties.  It is surprising that people don't regularly get mowed down or their shanties plowed into.

What little sidewalk there is is often cluttered as well with stalls and restaurants and repair shops and all kinds of junk that should not be there. 

But no one gets fined. Some of the restaurants I see have been there for years and no one gives a hoot.

Just imagine having to warn the people and make a national law to not obstruct sidewalks or play in the road! Does that sound like a law for adults or for children?
