Police Lt. Samad Baharan was gunned down by two men riding a motorcycle along Tandang Sora Avenue in Barangay Culiat, Quezon City on Saturday.
Despite having the highest audit rating in government the Office of the Vice President (OVP) was still flagged by the Commission on Audit (COA) for its slow use of medical assistance program funds which could have aided more people. 
According to COA’s audit report of the OVP for 2019 dated Friday, the office still has yet to utilize its P122.8 million pending medical assistance program (MAP) funds for 2019 — now totaling at P195 million — which could have facilitated financial aid for hospitalized indigents all over the country. 
As a result, lesser patients were given assistance.  COA said this goes against Presidential Decree 1445 or the Auditing Code of the Philippines, which mandates the efficient management of funds. 
The OVP and Vice President Leni Robredo noted that the delays in the disbursement of funds were not due to any corruption-related issue, but more on an issue of prudence as they were not allowed to make expenditures for their programs due to 2019 being an election year.
The OVP is flagged for not distributing medical aid funds fast enough but Robredo claims it was due to rules regarding spending during an election year.

A barangay official and 9 others will be facing charges for violating Presidential Decree 449, or the illegal cockfighting law, after getting caught participating in an illegal cockfighting activity (tukis or tigbakay in Cebuano) on Sunday afternoon in Barangay Bayacabac in Maribojoc town. 
Police arrested Jiovanni Lerin Rojas, 41, barangay captain of Calayugan Norte in Loon town, Bohol province.

Mayor Sara Z. Duterte lauded the efforts of the Davao City Police Office (DCPO) for the arrest of a village chief and a councilor of Barangay 10-A here for participating in illegal cockfighting on Sunday afternoon. 
“We need to thank them for their efforts and for taking time in finding and arresting these barangay officials. They do not shirk from their job on law enforcement,” Mayor Sara said in a radio interview on Monday. 
Duterte said that they have been receiving reports that Barangay 10-A village chairperson Marc Cayetano and barangay councilor Romeo Mamontayo have long been engaged in illegal cockfighting, despite the stern warning from the Inter-Agency Task Force (IATF) and the city government because of the prevailing coronavirus disease 2019 (Covid-19) pandemic. 
“We have long been hearing reports from their constituents. These government officials are supposed to be law-abiding citizens,” she said.
Everyone loves cockfighting in the Philippines. Even LGU officials.

Mayor Arvin Salonga of this town and his bodyguard survived an ambush in nearby Jaen town early on Tuesday (Sept. 8), police said. 
Col. Marvin Joe Saro, provincial police director, said the attack was captured by security cameras, which showed at least four assailants with two on a motorcycle. 
Investigators said Salonga, who was unhurt, was driving his car when the assailants shot his car around 8:30 a.m.

A policeman who had gone absent without leave (AWOL) was killed by four unidentified assailants at past 10 a.m. on Thursday, Sept. 10, in Barangay Tisa here. 
Ruben Quita suffered several bullet wounds on different parts of his body. 
His son, Gavin Rheuben Quita, who was with him during the ambush, also suffered gunshot wounds and is in critical condition in a hospital. 
Police Capt. Jonathan dela Cerna, Labangon Police Station chief, said Quita was with his son and two other companions onboard a Toyota Revo when the suspects riding two motorcycles waylaid the victim’s car and shot him several times. 
“They (the suspects) were using rifles. Their target was Quita but since his son was sitting beside him in the front seat, the son was also hit,” he said. 
Before the ambush, Dela Cerna said Quita was assigned in Mindanao.
An AWOL cop who was assigned to Mindanao was killed by rifle-wielding motorcycle assassins. So far no motive and no more information as the investigation remains ongoing.

On Tuesday, Governor Victor Yu ordered the suspension for 60 days of Mayor Ruel Molina who is facing an administrative case before the Sangguniang Panlalawigan filed by officials of a village in the town, allegedly for abusing his authority. 
Molina’s preventive suspension was recommended by the provincial legislature to prevent him from influencing witnesses or posing a threat to the safety and integrity of records relevant to his case. 
With Molina’s suspension, Vice Mayor Allan Damas was expected to take over the Office of the Mayor as officer in charge. 
However, on Tuesday evening, operatives of the Criminal Investigation and Detection Group arrested Damas by virtue of a warrant released on July 10, 2020, for a graft conviction. 
In a June 22, 2018 decision, the Sandiganbayan Sixth Division found Damas guilty of nepotism by appointing a relative as municipal treasurer in 2006, when he was the town’s chief executive. 
The anti-graft court ordered Damas imprisoned from six to eight years, and imposed on him a perpetual disqualification from holding public office. 
Damas and Molina ran under the ticket of Gov. Yu during the 2019 midterm polls. 
Top councilor Raniel Dormitorio was designated as the town’s officer -in-charge.
The Mayor of Kumalarang, Zamboanga del Sur has been preventively suspended because he is charged with abuse of authority and the Vice Mayor has been  arrested on a graft charge from 2006. Both of these men ran on the same party ticket as the governorHow is it that the vice mayor was convicted in 2018 but no warrant was issued for his arrest until 2020 thus allowing him to run for office?

A total of 211 elected public officials in the country are facing criminal charges over issues related to the national government’s social amelioration program (SAP), the Philippine National Police (PNP) reported Thursday. 
During the hearing of the House committee on appropriations on the budget proposal of the Department of Interior and Local Government (DILG) for 2021, recently-installed PNP chief Gen. Camilo Cascolan said that 447 individuals are facing criminal charges related to SAP. 
Of this number, 211 are elected public officials, 104 are barangay officials, and 132 are civilians.
That's really 315 LGU officials facing criminal raps over SAP anomalies.

During the House hearing on PCOO’s budget, House committee on appropriations chairperson Rep. Eric Yap asked Andanar whether PTV aims to compete with big networks, such as GMA Network when it comes to ratings since ABS-CBN is now shuttered since it was denied a franchise. 
(Now that ABS-CBN is out, do we have aspirations, goals for PTV-4 to compete with GMA, other networks?)
To which, Andanar answered: “Yes, we have a plan to at least be able to compete as far as ratings are concerned.” 
“The PTV, being a government-owned and controlled corporation, it also has to make its own money from advertisers.” 
Andanar said the PTV has likewise “beefed up” its news from morning to evening.
Unless they will be bringing back Probinsihyano I wouldn't count on it!

In a press statement, Integrity Monitoring and Enforcement Group (IMEG) chief, Brig. Gen. Ronald Lee, said Staff Sgt. Jonathan de la Cruz, currently assigned at the intelligence division of the Norzagaray Municipal Police, was arrested in an entrapment operation at the police station on Wednesday afternoon. 
Lee said de la Cruz was using a motorcycle that was found to be not included in the inventory of items they confiscated during a drug operation last August 26.  
“It was learned that the accused took custody of the motorbike and demanded PHP10,000 for its release. We are assuring the public that there is no letup in our campaign against misfits and scalawags in the force as ordered by PNP Chief, Gen. Camilo Cascolan. Everyone should know what to do and do it right,” he said. 
Aside from the motorcycle, recovered from de la Cruz were PHP10,000 in boodle money and a mobile phone.
Another cop busted for extortion. He was took a motorbike that was confiscated during a drug operation and demand P10,000 for its return.

A former vice mayor of Pamplona in Negros Oriental was gunned down Wednesday evening for a still unknown motive. 
A report from the Negros Oriental Provincial Police Office (NORPPO) on Thursday identified the victim as Kent Zerna Divinagracia, who was the civil security officer of the town at the time of his death. 
Initial police investigation showed that Divinagracia, who also became town councilor, was shot at around 8:40 p.m. at the town proper by suspect/s riding on a motorcycle. 
Divinagracia, 45, was rushed to the Silliman University Medical Center in this capital city, where he was declared dead upon arrival around 9:15 p.m.
A former vice mayor  of Pamplona now town councilor and civil security officer for the town was shot dead by motorcycle assassins.

The Department of Justice has reopened its probe into the quarantine protocol breach complaint against Sen. Koko Pimentel — this time to include a narration from the Makati Medical Center in the investigation. 
The investigating prosecutor will now also consider the incident report from the Makati Medical Center Medical Director Saturnino Javier, who said in March that Pimentel “violated his Home Quarantine Protocol [and] entered the premises of the Medical Center Delivery Room Complex.]” 
“In view of the foregoing and in line with the policy of admitting all evidence that could assist in the judicious resolution of complaints, the preliminary investigation of this case is hereby re-opened,” it added. 
The DOJ on July 24 wrapped up its preliminary investigation into Quicho’s complaint, after both Quicho filed a reply and Pimentel filed his own rejoinder.
The DOJ closed its probe without taking into consideration all relevant evidence? Ridiculous but par for the course.

Coronavirus Lockdown: New Order, Underground Hospitals, and More!

More news about how the COVID-19 pandemic in the Philippines is being handled by the public and the government.

The number of those infected with COVID-19 continues to rise and there is no stopping it in sight. That is not preventing officials from making overly positive forecasts.

Defense Secretary Delfin Lorenzana, chair of the National Task Force (NTF) Against COVID-19, is confident that the flattening of the curve will finally be achieved within the month. 
Such can be done with the help of every Filipino who should follow all health protocols aimed at putting an end to the pandemic, Lorenzana said. 
“Yes, we can. What will we do to achieve it? Strictly implement the health protocols and follow the campaign plan developed by the NTF,” Lorenzana told journalists yesterday. 
He said the key is to abide by or follow the acronym PDITR, which stands for protect, detect, isolate, treat and reintegrate. 
Lorenzana said such system contains step-by-step processes that should be implemented at work, at home and even when travelling to prevent the spread of the coronavirus. 
“The NTF has disseminated this to the businesses, Regional Task Forces and LGUs (local government units),” he said, when asked on the prediction of University of the Philippines researchers that the curve may finally flatten this month. 
“If everyone follows this plan, we will not only flatten the curve but bring it down,” Lorenzana said.
Once again the onus is being put on the public to stop the spread of the virus. Could the real problem be that the virus is not stopped by flimsy face masks and silly face shields or even alcohol sprays? Perhaps the virus continues to spread because of its nature which allows it to transcend such barriers.

The COVID-19 pandemic has left a long trail of hazardous waste in its wake.

The Department of Environment and Natural Resources on Wednesday reminded the public as well as hospitals, clinics, laboratories, and even businesses and companies of the proper way to dispose of hazardous wastes amid the coronavirus disease (Covid-19) pandemic. 
The DENR made this reminder after hundreds of used rapid test kits were left scattered along M. Dela Fuente Street in Sampaloc, Manila on Tuesday evening. 
DENR Undersecretary for Solid Waste Management and Local Government Units Concerns Benny Antiporda in an interview over DZBB said that there is a color coding scheme in disposing of hazardous wastes. 
“Let me remind everybody that we have a correct process in disposing of our hazardous wastes. We can place it in a yellow bag or if not, in any trash bag and put a visible label on it,” Antiporda said. 
Antiporda said yellow is the color for “hazwastes”.
How hard is it to properly dispose of your garbage?  Apparently it is quite hard in the Philippines.

The word among the conspiracy crowd is that COVID-19 is fake and those who run the world are trying to shake things up and fairly bring bout a new world order.

President Duterte has urged fellow leaders to seize the opportunity presented by the coronavirus disease pandemic to build a “new order” that is more secure and sustainable by strengthening economic and defense cooperation. 
“For the first time, all of humanity fear the exact same invisible menace. Not even the Second World War had this most sweeping effect... The repercussions, as we are seeing now, are grim and far-reaching. We have economies in recession, institutions in crisis and societies in state of uncertainty,” he said. 
“But the path to recovery requires more openness, deeper solidarity and stronger cooperation among nations,” he added. 
“Let us seize this historic opportunity to build a new order: one that is more secure, just and humane – where there is no room for the barbarity of terrorists and extremist forces. And one that is fair, equal and sustainable – where progress and prosperity are enjoyed by all,” he said. 
“Let us, therefore, honor those who have fallen to the invisible enemy that is the pandemic and the scourge of terrorism. Let us commit ourselves to enduring partnership and cooperation. For indeed, together, we shall prevail,” he added. 
“Narrowing deep-seated inequalities was challenging in times of economic growth. It is more so now when the global economy, ours included, has slumped. Resources are shrinking, while inequities are worsening. Reviving the economy is, therefore, vital,” he said. 
“Economic self-sufficiency may seem a logical response to the supply chain disruption we saw at the start of the pandemic. It may sound rational to those who perceive themselves to be on the losing end of globalization. But economic independence is not the answer,” he added. 
“We will expand the digital economy to boost growth and create employment. And we will harness technology to allow businesses – especially (micro, small and medium enterprises) – access to regional and global supply chains,” he said. 
“The path before us is clear: we will enhance cooperation with the ASEAN, the United Nations and other international partners like Jordan,” he said.
When even Duterte, who has cursed the UN and the EU and other international partners, starts spewing stuff like this perhaps the conspiracy crowd is on to something.

Remember when several underground hospitals for Chinese nationals were busted up by the PNP a few months ago?  Turns out there might be more.

Authorities are validating reports about the existence of other underground hospitals for Chinese nationals amid the COVID-19 pandemic, a police official said on Friday. 
Police Brigadier General Rhoderick Armamento, Philippine National Police-Criminal Investigation and Detection Group deputy director for administration, told Dobol B on News TV that they are checking if there are also underground hospitals in Metro Manila and in CALABARZON. 
"Right now, we are still validating some reports and our intelligence build-up is going on. Not only in Region III, we also have areas in Region IV-A, Metro Manila," Armamento said. 
The Alliance for Consumer and Environmental Protection (ACAPE) Inc. has urged the national government to probe those behind the alleged clandestine hospital, which catered exclusively to Chinese patients who tested positive for COVID-19. 
In May, police raided an "underground" hospital wherein a former leisure village was converted into an illegal pharmacy and seven-bed makeshift hospital for Chinese nationals infected with COVID-19 in Pampanga.
Aside from login after alleged underground hospitals the PNP is also on the lookout for quarantine violators flouting the rules online.

In a statement issued Saturday, JTF COVID Shield Commander Police Lieutenant General Guillermo Eleazar said netizens have been posting on social media to complain of violations of minimum health safety standard protocols, including mass gatherings for drinking sessions and other forms of celebration. 
Aside from this, some netizens are also uploading photos and videos of celebrations they have attended despite the prohibition under the community quarantine. 
Eleazar added that other Facebook pages show photos and videos of quarantine protocol violations on the streets that are captured by closed circuit television (CCTVs) and dashcams. 
"The social media are full of photos and evidence of hardheaded people deliberately violating the quarantine protocols. These can be used as pieces of evidence to warn, to fine and to summon the people concerned in coordination with the barangay officials concerned," Eleazar said. 
Among the violations posted on social media are motorcycle pillion riding and drinking sessions. 
The JTF COVID Shield commander said those caught having joined drinking sessions could face additional charges especially if their respective communities are implementing a liquor ban.
Remember when the PNP killed an alleged drug dealer and said they validated him as such through social media posts? Then remember how the PNP lied about the whole incident and now two cops are in prison for his murder? Social media alone is no proper way to validate if someone is breaking the law.

The DENR has inexplicably spent millions of pesos on a beautification project on the shores of Manila Bay. The justifications have been many and one has to do with the pandemic.

Presidential Spokesperson Harry Roque defended the move to fill Manila Bay with artificial white sand, noting this could boost the public's mental health in the middle of the coronavirus pandemic. 
"(Amid the pandemic, we also need to take care of our mental health. I think walking along places like Manila Bay with white beach, you can't quantify its effect to the mental health, the peace of mind and break)" he said during an ambush interview on Saturday.
Walking along Manila Bay? Isn't the government attempting to limit people's movements while the pandemic is raging? It's as stupid an answer as it is a project.

A netizen shares his blessings with random people in a mall with his treasure hunt-inspired game. 
Vicente Alcarez, 25, a private school teacher from Cebu, did not spend his money on things in the mall but rather, he shared P500 bills with strangers. 
Alcarez filmed this project last August 10, the original plan was to let people around the mall figure out where he hid the bills, which he uploaded on September 1, 2020. 
But he thought it might take forever for the people to find it, and so he opted to listen to some of the suggestions online about giving it instead to those working during this pandemic. 
And so he did by uploading another video just yesterday, September 5. 
“During the quarantine, people have been hooked to watching different vlogs, and so I thought of maybe giving it a try to give positive vibes and extend help to the community and the frontliners. I thought of this game, hiding a 500 peso bill in the mall,” he said. 
He called four players to participate in the game, one is a food delivery rider, two mall janitors, and one sales lady from his favorite boutique in the mall. 
Alcarez instructed them about the game and gave them hints to locate the hidden P500 bill. 
“I received a lot of good feedbacks that made me realize that it’s always far better to give than to receive. Upon seeing their smiles and reading people’s comments as well, many people were so happy about it that it gave me more motivation to make more videos like this,” he added. 
What a good way to give back and have a little fun, right? But worry not as Alcarez was following all the safety protocols in the mall like social distancing and full protective gear like the mask and the face shield.
It seems rather convoluted and unnecessary. Notice that none of the frontliners he asked to play the game are nurses or doctors.

COVID-19 is spread through moisture droplets so what better way to stop the spread of the virus than by banning sneezing and spitting?

Under the measure, those who would spit, sneeze or commit similar “involuntary acts without proper corner” in public places would be fined P500 up to P5,000 depending on the offense count. Succeeding offenses merit attendance in a health seminar. 
Mayor Francis Zamora said the ordinance aims to curb the spread of COVID-19, citing an apparent increase in cases due to such acts. 
“Sneezing and other similar acts without proper protection such as face masks and shields are strictly prohibited,” the city government said. 
Urinating, vomiting and defecating in public places are also prohibited.
Sneezing while wearing a facemark, how does that work? Has the rise in cases been absolutely correlated to and causally linked with an increase in public spitting and sneezing?  Good to see they finally prohibited public vomiting, urinating, and defecating.

Experts at the UP claim the August MECQ has flattened the curve. Even Duterte has concurred and thanked the public for following protocols. The DOH says not so fast.

The Department of Health cannot yet confirm that the Philippines has flattened its COVID-19 pandemic curve, an official said Tuesday. 
President Rodrigo Duterte on Monday said the country has flattened the pandemic curve,lauding the public for following health protocols imposed by government. 
On Sunday, Dr. Guido David of the UP OCTA Research Team said Metro Manila and Calabarzon are starting to flatten the pandemic curve, as the virus reproduction rate in the two regions is estimated at 0.95, below the threshold of "1." 
Health Undersecretary Maria Rosario Vergeire, however, said authorities still need to conduct further study as the objective of flattening of the curve is to "spread the increase of the number of new cases over a longer period of time" to avoid overwhelming the healthcare system's capacity. 
(We will see but we will continue our strategies. We cannot really confirm yet that this is what we call the flattening of the curve.) 
(We need to conduct more studies, we need to look at all the factors. Though our numbers are going down these past days, we need to look at the state of our health system.)
Perhaps the UP is confusing correlation with causation. It is as very easy mistake to make.

The Mayor of Manila has effectively canceled Undas this year.

Manila Mayor Isko Moreno on Tuesday announced that the city would be closing cemeteries from October 31 to November 3 to prevent the possible spread of the novel coronavirus. 
(From now until October 30, you can go visit. The point is as early as now, you can go and visit your departed loved ones.) 
The order is in his recently signed Executive Order No. 38, with the dates covering days of traditional annual visits to cemeteries, which draw millions.  
(Please bear with us but this is an effect of the new normal. I will give you a change and in case the situation gets better in this pandemic, meaning if there would be no more COVID-19 cases in Manila by October 31, then I will rescind this executive order.) 
The temporary closure covers all public and private memorial parks, cemeteries and columbaries in the city.
Undas could be back on but only if there are no COVID-19 cases in Manila by October 31st. That seems highly unlikely. This measure will likely be copied by cities across the nation.

Some COVID-19 patients under quarantine are losing their composure.

An 85-year-old man positive of coronavirus disease (Covid-19) has attempted to burn down the isolation facility here a few days after he escaped from the Region 1 Medical Center (R1MC) in Dagupan City. 
The police said the patient burned a table and broke some window glasses while he was locked inside the Don Primitivo S. Perez Social Hall on Sunday. 
In an interview on Tuesday, Senior Fire Officer 4 Rogelio Quizon Jr., acting municipal fire marshal, said the fire started after a mosquito coil (katol) burned the papers in the table. 
The patient is admitted at the Pangasinan Provincial Hospital in San Carlos City, where he is under strict monitoring.
He was admitted to the R1MC on August 30 after testing positive for Covid-19.  
On August 31, the patient was seen roaming in the city hall complex after allegedly escaping the hospital. 
Mayor Kenneth Perez has ordered that the patient be returned to R1MC, but the doctors refused him to be readmitted, prompting the local government unit to put him in the town’s isolation facility. 
The patient begged to be allowed to go outside, but it was not granted since he is a Covid-19 positive causing him to threaten the nurses that he would burn down the facility. 
Meanwhile, Perez is set to ask the Sangguniang Panlalawigan to investigate the incident, citing the hospital’s lax on security which made the escape of the patient possible. 
Could we see more of this kind of behavior in the future now that the DOH has banned home quarantine?

The government will strictly disallow home quarantine for COVID-19 patients, Interior Secretary Eduardo Año said on Tuesday. In a television interview, Año said the government planned to implement the new policy “within the week.” 
Año said the joint memorandum of the Department of Health (DOH) and the Department of the Interior and Local Government that allows home quarantine for mild and asymptomatic patients and those without underlying conditions who have their own rooms and bathrooms would be amended to make way for the new policy. 
“It’s really best that we isolate everyone, rich and poor,” Año said, adding that the well-to-do should not worry as the government has turned hotels into isolation centers. 
“We have COVID-19 hotels where they can be isolated,” he said. “[I]t is very important to get them out of their homes because their family will be infected. That is for the good, for the sake of family members.” 
But there would be exemptions, Año said, especially the elderly who could not be moved to isolation centers. 
He said health and local officials would look into situations to make sure those who would ask to self-isolate had valid reasons.
This decision overturns what the DOH said a few days prior when they assured the public they would allow asymptomatic patients and those with their own room and facilities to stay at home.

Is there any other nation in the world requiring the public to wear face shields and face masks?  I cannot think of any. It's really just an extra burden which won't stop the spread of the virus and makes it hard to see because of the glare.

In the Case of Joseph Pemberton Filipinos Have Only Themselves to Blame

The death of Jeffery Laude in 2014 and the ensuing events is one heck of a farce. I am tempted to say it is hilarious as all the circumstances surrounding his death and the subsequent incarceration of Joseph Pemberton have become a part of the clown world which is now our pathetic every day reality.

Filipinos are angry that Pemberton, who was sentenced to 10 years, has now been ordered released after only serving half that time because of good behavior allowances. Well, they only have themselves to blame as it is Filipinos who wrote the Good Conduct Time Allowance law which has paved the way for Pemberton's release. It is also Filipinos who nurtured the culture which allowed Jeffery Laude to live the sordid life which ended in his death. If anything Pemberton has simply been unwittingly caught up in the absurd twilight zone that is the Philippines. 

The timeline of events is rather straightforward. Pemberton met a woman at a bar and went back to a hotel with her and had anal and oral sex. Only she was a man!!

US Marine Joseph Scott Pemberton did not know Jeffrey “Jennifer” Laude was a transgender, a witness told the Senate as it opened its own inquiry yesterday into the Oct. 11  killing. 
Evidence recovered at the crime scene also indicated anal sex occurred in the hotel room where Laude was found dead, although it has not yet been determined who engaged in the sex. 
The Senate foreign relations committee started its probe into the death of Laude in Olongapo City, with the victim’s transgender friend, Mark Clarence “Barbie” Gelviro, narrating the events on the fateful Saturday night. 
“Ang alam po ni Pemberton kami ay mga totoong babae (Pemberton thought we were real women),” Gelviro told the committee chaired by Sen. Miriam Defensor-Santiago, who later said she considered the evidence against the suspect “damning.” 
Chief Superintendent Theresa Ann Cid, chief of the Philippine National Police Crime Laboratory, said evidence recovered at the crime scene included strands of hair, two used condoms, blood and urine samples. The PNP is still completing the tests on the evidence. 
Told about the condoms, Santiago remarked: “At least we can safely say that the suspect, or what they call in America as a person of interest, ejaculated twice. Would that be correct?” 
Cid replied, “Not necessarily, your honor. The first condom has fresh seminal fluid, with fecal material. The second condom seems not to have the presence of semen… Apparently, they were used.” 
Chief Inspector Reynaldo Dave, PNP medico-legal officer, said it was safe to say that the condoms were used in anal sex. The police experts, however, said they could not conclude that the semen samples belonged to Pemberton. 
“If he was a male, how does he have sex with the Marine?” Santiago asked. 
“I just have to corroborate with the findings on condoms and the other pieces of evidence,” Dave replied. “We can safely conclude (anal or rectal sex).” 
Santiago said anal sex is “the usual method for transgenders.” 
After the hearing, Santiago said the evidence appeared to be “damning” and there was “cruelty” in the killing.
Is there any homicide that is not cruel? How about the cruelty and the shame of tricking a young man into thinking you are a woman, going back to a hotel with him, and persuading him to sex you in the butt!? This is the reason to which Pemberton admitted why he strangled Jeffery.
United States Marine Lance Corporal Joseph Scott Pemberton, on trial here for the alleged murder of transgender Filipina Jeffrey "Jennifer" Laude in October 2014, admitted he strangled her but added it was "in self defense." 
Pemberton appeared at the Regional Trial Court Branch 74 as a witness for the defense on Monday, August 24. 
Private lawyer for the Laude family, Harry Roque, told the media in a press briefing that Pemberton made the admission during his testimony. 
Roque said Pemberton told the court Laude was performing oral sex on him when he suddenly felt a penis when he put his hand between Laude's legs. 
The US serviceman said he was shocked at the discovery and pushed back Laude who fell from the bed but got up and went to him to slap him in the face. 
He said he retaliated by putting his hand in Laude’s neck, choking the victim. 
He said he saw Laude stopped moving and thought the victim lost consciousness because of what he did. He dragged the body to the bathroom to try to pour water to revive Laude. 
He said he found no water in the bathroom so he decided to just leave Laude there.

On December 1, 2015 Pemberton was convicted of homicide, not murder, and sentenced to 10 years in prison. But instead of being sent to New Bilibid he was given his own special cell at Camp Aguinaldo. The judge who convicted him ordered him to be sent to NBP because she was unaware of the agreement the Philippine and US governments cut which mandated Pemberton stay confined at Camp Aguinaldo.

Lawyer Jose Justiniano said the issue of Pemberton’s place of detention following his conviction was governed by what the United States and Philippine governments may decide, in accordance with the terms of the Visiting Forces Agreement (VFA). 
Justiniano said that when he was with the DOJ as the undersecretary in charge of the Laude case, an agreement was reached sometime in August between the Department of Foreign Affairs, the US Embassy and the VFA Commission that Pemberton would be detained at Camp Aguinaldo if he were convicted. 
“There was an agreement but I did not see if it was a signed agreement,” he said, adding that the DOJ was not a primary party to the agreement. 
The lawyer said the agreement was not made known to the judge for reasons of “prematurity.” He said this was why the Olongapo judge ordered that Pemberton be detained at the New Bilibid Prison in Muntinlupa City until Philippine and US authorities produced an agreement on where Pemberton was to be detained. 
“[The judge] was not aware and the reason is, it was premature for the judge to know since there was still no judgment when the agreement on [Pemberton’s] detention was agreed upon,” he explained.
If the agreement was made months before the conviction in December one would think the judge would have been informed by then.  Why leave her out of the loop even at the last minute and cause all the confusion? Whose fault is that if not the DOJ's? Pemberton's new cell was to be rebuilt and brought up to international standards.  This begs the question about the state of all the other prison cells inside Camp Aguinaldo as well as elsewhere in the BuCor system.
In accordance with the terms of the Visiting Forces Agreement (VFA), the US and the Philippines have agreed that the facility at the barracks of the Armed Forces Custodial Center should be Pemberton’s place of detention where he will serve out his 6-to-12-year sentence for the killing of transgender Jennifer Laude at an Olongapo City hotel last year. 
However, the US has requested that the facility be improved, said BuCor director general Ricardo Rainier Cruz III. 
“It should meet international standards… There was a request to improve it, the expenses will be mutually shouldered,” Cruz said in a phone-patch interview. 
Since his conviction by an Olongapo court last Tuesday, Pemberton has been incarcerated at his old cell, a 20-foot airconditioned container van. 
Pemberton’s soon-to-be new home is less than 100 meters away from his current detention cell. The AFP custodial center can accommodate up to 50 people. 
The physical security of the new jail cell will be improved by securing it with barbed wire and installing more surveillance cameras to keep an eye on the convicted US Marine. Pemberton’s new jail cell may also be repainted and redesigned to make the temperature cooler. 
The cost of the renovations will be shared between the BuCor, the AFP and the US government. 
According to Cruz, even before Pemberton was convicted last Tuesday, US and Philippine authorities through the Visiting Forces Agreement Commission had already agreed on Camp Aguinaldo as the possible detention area.
“There was an agreement already between the BuCor, the AFP, as well as the Department of Justice and the Philippine National Police, that he won’t be detained at the NBP,” he said. 
He said this was provided for in the VFA, and that the renovations to Pemberton’s jail cell was also provided for in the VFA.

To sum up a young man goes to a hotel with a woman and has sex with her. When he finds out she is actually a man he freaks out and chokes him. He is later convicted of homicide and is allowed to serve his ten year sentence in a specially built cell in Camp Aguinaldo rather than having to suffer in the general population of New Bilibid Prison. 

Did Pemberton not get a refresher course on Filipino lady-boys? Did none of his CO's or even the men in his unit warn him that if you reach down on some of the pretty Filipinas you will feel a penis? The Philippines prides itself on being the only Christian nation in Asia so why do they continue to nurture bakla, or homosexual, culture? The answer is quite long but baklas, men who act like women, have been around since long before the arrival of the Spanish. In fact these men are allegedly not merely acting like women but are something else altogether.
In Filipino culture, the soul of the mind is the “true soul”. It is known in Tagalog as the kaluluwa (also kaduwakaruruwa, kaluhakalagdungan, etc. in other Philippine languages, meaning “twin” or “companion”). It resides in the head and governs your thoughts, emotions, and personality. It leaves your body during dreams, delirium in sickness, trance states, and insanity. 
The other soul is known as the ginhawa or hininga (meaning “breath” or “life force”). It is located in the pit of the stomach (interestingly, also the seat of the enteric nervous system, the “second brain”). It governs things like body processes and instinctive urges like hunger, It is basically your physical self. It is tied to the body. If it ever leaves the body, the body dies. 
Thus, a man is a male mind in a male body, while a woman is a female mind in a female body. This also means they can be inverted. A female mind can be in a male body, and a male mind can be in a female body. 
These inversions are the bakla (men who live as women) as well as the binalaki (women who live as men).
The acceptance of bakla however, was so culturally entrenched, that even though the Philippines became predominantly Catholic, they didn’t really disappear. Though they couldn’t become shamans anymore. they still pretty much filled in the roles of “mediators” in Filipino communities, often becoming comedians and entertainers. As long as they didn’t delve into shamanism again or got caught in the act of homosexual sex, the Spanish clergy tolerated them. 
That’s basically how they survived into the modern era, and why they are comparatively still more socially accepted than in western societies. They’re a cultural relic. One of the last remnants of the animistic roots of Filipino society.

Didn't anyone warn Pemberton about these creatures? And why didn't Jeffery reveal that he was a man?  There are men who love to go with lady-boys.  He did not need to deceive Pemberton. So why did he do it? How many times had he gotten away with it? Was it a turn on for Jeffery to trick straight men into having butt-sex with him?

Fast forward to September 2020 and now Pemberton has been ordered released due to good behavior points earned according to the Good Conduct Time Allowance (GCTA) law.

In an order dated Sept. 1 and signed by Olongapo RTC Presiding Judge Roline M. Ginez-Jabalde, Pemberton has a total accumulated time served of 10 years, one month, and 10 days. The computation has included the Good Conduct Time Allowance (GCTA). 
The Uniform Manual on Time Allowances and Service of Sentence defines GCTA as a “privilege granted to a Person Deprived of Liberty (PDL), entitling him/her to a reduction of prison term for every month of actual detention or service of the sentence as a reward for good conduct and exemplary behavior.” 
Republic Act 10592 has increased the GCTA provided to persons deprived of liberty. 
Under the Law, in the first two years of imprisonment, the deduction has been increased from five days of each month of good behavior to 20 days. On the third to the fifth year inclusive of his imprisonment, the deduction has been increased from eight days to 23 days for each month of good behavior during detention. The following year to the tenth year inclusive of imprisonment, the deduction has been increased from 10 days to 25 days for each month of good behavior, and on the 11th month and successive years, the deduction has been increased from 15 days to 30 days. 
In the case of Pemberton who was preventively detained for 405 while his trial is ongoing earned 260 GCTA points while in the succeeding years of his detention after he was convicted, he earned the perfect score of 20 days deduction per month from December 2015 and the 12 months of 2016. 
For 2017 to December 2019, he earned 23 days reduction per month and 25 days per month from January to August 2020. 
Finally, accused Pemberton has a total accumulated time served with the entitlement of GCTA of 10 years, 1 month and 10 days which is more than the 10-year maximum penalty imposed by this court and affirmed by the Court of Appeals. Thus, he is now entitled to be released for he had already served the 10-year maximum penalty,” the court said. 
Pemberton’s actual imprisonment is only six years.
Here is the text of the actual law which was signed by President Aquino in 2013.
Section 3. Article 97 of the same Act is hereby further amended to read as follows: 
"ART. 97. Allowance for good conduct. – The good conduct of any offender qualified for credit for preventive imprisonment pursuant to Article 29 of this Code, or of any convicted prisoner in any penal institution, rehabilitation or detention center or any other local jail shall entitle him to the following deductions from the period of his sentence: 
"1. During the first two years of imprisonment, he shall be allowed a deduction of twenty days for each month of good behavior during detention; 
"2. During the third to the fifth year, inclusive, of his imprisonment, he shall be allowed a reduction of twenty-three days for each month of good behavior during detention; 
"3. During the following years until the tenth year, inclusive, of his imprisonment, he shall be allowed a deduction of twenty-five days for each month of good behavior during detention; 
"4. During the eleventh and successive years of his imprisonment, he shall be allowed a deduction of thirty days for each month of good behavior during detention; and 
"5. At any time during the period of imprisonment, he shall be allowed another deduction of fifteen days, in addition to numbers one to four hereof, for each month of study, teaching or mentoring service time rendered.

It is not my intent to delve into the controversy surrounding this law. Rappler has a timeline which can be read here. It is also not my place to determine whether or not Pemberton actually qualifies under the GCTA law. The court says he does and that decision is being challenged. My intent is to take a look at the law itself. 

We see in the case of Pemberton that his sentence has been halved all because he was a good boy. For every month of good behavior practically a whole month is deducted from a prisoner's sentence! If a prisoner messes up and displays bad conduct his good conduct allowances are not forfeited!
Section 5. Article 99 of the same Act is hereby further amended to read as follows:" 
"ART. 99. Who grants time allowances. – Whenever lawfully justified, the Director of the Bureau of Corrections, the Chief of the Bureau of Jail Management and Penology and/or the Warden of a provincial, district, municipal or city jail shall grant allowances for good conduct. Such allowances once granted shall not be revoked."
What you have in this law is an absolute travesty of justice. What kind of justice is it when a person can nullify their prison sentence by their behavior? Potentially a prisoner can knock off 240 days of his sentence each year, more as his imprisonment continues, just because of good behavior and all of that is irrevocable even if he exhibits bad behavior. There is thus ample encouragement of good behavior through a system of merits but no discouragement of bad behavior through a system of demerits. Good behavior is also not defined which further exacerbates the problems with this law. Such a law is ripe for abuse and it is no wonder that the GCTA law has indeed been abused by BuCor officials and prisoners.

Who thought this law was a good idea? Even in the USA a prisoner can only earn 54 days of good conduct allowance per year and it can be forfeited due to bad behavior. Filipinos only have themselves to blame for this unjust law. They crafted it and they signed it into law. Don't blame Pemberton for taking advantage of it and using it to his benefit. Why shouldn't he? Instead blame should be heaped upon the short-sighted politicians who made the GCTA law. Politicians like Senator DeLima.

Senator DeLima, who helped craft this law, amazingly claims there is a salutary wisdom behind it.
“We’re probably looking at another case here of misapplication or abuse of the GCTA Law which is unfortunate as it undermines the very wisdom and salutary philosophy behind said law, a tool for restorative justice and intended only for deserving PDLs,” De Lima said in a statement, reacting on the early release of Pemberton who killed transgender Jennifer Laude.
De Lima further slammed the order to release Pemberton, saying it “replaced justice with injustice and reopened wounds that started healing when Laude’s murderer was convicted and imprisoned.” 
The senator also questioned how the convicted murderer was given a “free pass” by the court. 
“After much ruckus over the Good Conduct Time Allowance (GCTA) controversy, former US marine Scott Pemberton, who was convicted for the murder of transgender Jennifer Laude, has been allowed by Olongapo City RTC, Branch 74 a free pass. Sa kabila ng bigat ng krimen na ginawa niya, parang napakadali para sa korte na palayain siya nang maaga,” she said. 
(Despite the gravity of his crime, it seems so easy for the court to release him early.)

First of all Pemberton was NOT convicted of murder. He was convicted of homicide. The two are not the same. This is a crucial distinction because under the implementing rules and regulations (IRR) of the GCTA those convicted of heinous crimes like murder are exempted from availing from the law. Homicide is not listed as a heinous crime under those rules.

Second of all that "free pass" is written explicitly into the GCTA law. What wisdom is there in a law where a prisoner can shave off 8 months of his prison sentence per year through good behavior and not lose any of that accumulated merit through bad behavior? The very GCTA law itself undermines the philosophy behind any mode of justice. Justice, while it can be restorative and reformatory, must also be punitive. Crime and punishment isn't just one of the greatest novels all time, it is the bedrock of an orderly and safe society. If you commit a crime you must bear your punishment.

Probably one of the dumbest takes on this whole situation is that of Harry Roque who was counsel for the Laude family.



The death of a Filipino man by a foreigner for the reason that he was committing fraud in presenting himself as a woman and tricked the foreigner into having sex with him personifies the death of Philippine sovereignty? Actually the whole situation personifies life in the Philippines where much of the culture is based on deception and lies thus forcing one to do whatever it takes to survive.

Let me be completely clear that Joshua Pemberton is wholly responsible for the death of Jeffery Laude. But let's not fool ourselves either. Nothing happens in a vacuum. Except in the Philippines where everything sucks!

After writing all the above and preparing to publish it Duterte, straight out of left field and stunning the nation, cut the gordian knot and granted Joshua Pemberton an absolute pardon thus absolving him of any criminal liability for his actions.

Presidential spokesperson Harry Roque said Pemberton can now be released from jail and his good conduct time allowance (GCTA) is no longer an issue. 
(This means that Pemberton can now walk free, his entitlement to GCTA, and whether the law is applicable to him are no longer in question. The President has erased other punishments to be imposed on Pemberton.) 
(What the President did not erase was Pemberton’s conviction; he is still a murderer but the other penalties he may receive were already erased by the President.) 
Asked the reason behind the President’s decision, Roque said: “Hindi na po kinakailangang bigyang dahilan ng Presidente yan dahil yung pag grant po ng pardon at parole, yan naman po ang ating sinasabi na hindi po yan katungkulan ng hudikatura, kung di katungkulan ng ehekutibo.” (A reason is no longer needed because granting pardon and parole is not the duty of the judiciary but of the executive.)
Why did Duterte grant Pemberton an absolute pardon when the Palace said earlier that granting him an early release is unjust judicial overreach? According to Roque no reason is needed. It is Duterte's prerogative to grant pardon to whomsoever he will. Later the President explained his decision by saying that Pemberton had been been treated unfairly and that he deserved the presumption of good character and to avail of the GCTA law.
The President explained that Pemberton should have been presumed to have exhibited good moral character while imprisoned, given that authorities did not report otherwise. 
"We should allow him the good character presumption, kasi wala namang nag-report na Marines na nagsabing nagwawala siya," Duterte said in a public address. 
(The Marines did not report anything about him acting out.) 
"You have not treated Pemberton fairly. So, i-release ko. Pardon. Eh ang pardon, walang mga question 'yan (there are no questions there)," Duterte said, noting that he discussed the matter with Executive Secretary Salvador Medialdea and Justice Secretary Menardo Guevarra. 
"In fairness, tapos na 'yung kwentada. He was recommended to be released. Eh, i-release mo," he said. 
(In fairness, the computation has been made... So, you release him.) 
Duterte claimed he was not taking sides with his decision. 
"I am not favoring anybody--neither Pemberton, nor the family [of Laude]," he said.

"And to do justice." What is just about this decision of an absolute pardon? How does the President granting such a boon do justice to the victim or his family? The Laude family is not pleased at all with this decision as they had sought relief from the court to block Pemberton's release. A decision from the court would have decided whether or not prisoners subjected to the VFA are able to avail of the GCTA law which would have settled any similar disputes in the future. Presidential Spokesman Harry Roque will also likely be displeased with Duterte's decision as he called Pemberton's early release symbolic of the death of the Philippines' sovereignty. As Duterte's mouthpiece he must swallow whatever indignation he might harbor against this decision and tow the line or forfeit his job.

Once again Joseph Pemberton is simply caught along in the sweeping river of absurdity that is life in the Philippines. Filipinos have only themselves to blame in this whole matter. It is they who crafted the GCTA law which might have led to his release and it is the President they elected who granted Joseph Pemberton an absolute pardon.
