A municipal councilor in this town was fatally shot early Thursday by unidentified assailants on a motorbike, police said.

Roberto Carpio, a resident of Barangay Luyos and a two-term member of the municipal council, was driving his motorcycle when ambushed around 7:30 a.m. by two men wearing black shirts and shorts aboard a black single motorcycle, without a helmet, in Barangay Sto. Cristo in this town, an initial investigation showed.

The victim had gunshot wounds in the head, while the assailants fled northward, according to a police report.

Carpio was taken to the nearest hospital where he was pronounced dead upon arrival.

Authorities have begun reviewing security camera footage to identify and apprehend the suspects. The motives behind the attack have yet to be determined.

A town councilor has been assassinated.

The Anti-Red Tape Authority (ARTA) said it has successfully prosecuted eight red tape cases for this year alone, with five of these cases coming from the Land Transportation Office (LTO).

In a media forum, ARTA director-general Secretary Ernesto Perez said the conviction of the said cases proves that ARTA is serious in quelling anomalous transactions within government offices.

"We want to set an example. You know that we in government don't want to press charges. We don't want to be facing charges before the Civil Service Commission, before the Office of the Ombudsman, before any regular court.

"So, we would like to send that strong signal. So that is why in the last two years we have conducted entrapment operations. Most are from the Land Transportation [Office], he added.

According to Perez, five of the red tape cases that they have successfully prosecuted were from the LTO, one from the Bureau of Fire Protection (BFP), one from the Philippine Statistics Authority (PSA), and another from an undisclosed local government unit.

Despite this, the ARTA official recognized the reforms that LTO has implemented to improve its services whether online or walk-in services.

"They have improved thier services, they are fully digitalized. When you apply for your driver's license, you can get it in a matter of minutes," Perez said.

"If you walk-in, it's also quick for walk-in application, half-day you can get it," he added.

Meanwhile, Perez hoped that government agencies would realize that ARTA is only doing its job.

"ARTA is very serious in this matter— to streamlining and improving our government processes. It is the advantage of our people to give them the strong signal that there is an agency that is looking at their performance, that there is this agency that is serious about implementing the law, that is conducting entrapment operations to catch fixers," he said.

"It's the same with the LTO. We know that you don't need fixers anymore because the process of renewing your driver's license and getting your vehicle's registration is fast," he added.

Perez encouraged the public to file complaints with ARTA against erring officials.

"Let us know so that we can be of help," he said.

The Supreme Court affirmed the liability of former Philippine Amusement and Gaming Corp. (Pagcor) Chair Efraim Genuino in the company’s disallowed donations totaling P550,000 to a private residential subdivision in Makati City in 2008.

In a 16-page decision promulgated on June 13, 2023, but published only on Thursday, the high court denied Genuino’s certiorari petition questioning the Commission on Audit’s (COA) ruling that the donations were “private in purpose” and he was liable for approving it.

It also remanded the case to the COA for a final determination of the amount Genuino should return.

In 2011, a notice of suspension was issued regarding Pagcor’s donations totaling P550,000 to the Magallanes Village Association Inc. for improving Magallanes Avenue, San Gregorio, and Magdalena Streets in Makati City.

Genuino argued that the board of directors, and not him, approved the payout of Pagcor funds.

The high court, however, said that aside from being the government firm’s CEO, Genuino was also the board chair and was present when they approved the first donation of P330,000.

“Just as in the 2023 Genuino Resolution, therefore, and applying once again the guidelines laid down in Torreta v. COA, Genuino is found personally liable for the donations as an approving officer and for his showing of gross ignorance,” it added.

The court disagreed with Genuino’s claim that the donations were valid for a “sociocivic and public purpose.”

It cited information from the Makati City administrator, who said the streets had not been turned over to the local government.

The high court also noted the COA’s earlier finding that Genuino was a resident of Magallanes Village.

“Without delving further into the additional ramifications of this finding of the COA, the court finds that these considerations, together with the lack of [proof] showing that the donations [were] mainly for a public purpose, all lead the court to rule that the disallowance of the donations was indeed proper,” it said.

The former PAGCOR chairman has been found liable for disallowed donations.

A former village official in Daraga town of Albay on Tuesday filed administrative and criminal charges before the Office of the Ombudsman against Gov. Edcel Greco “Grex” Lagman for allegedly receiving around P8.16 million as payola (payoff) from the operation of “jueteng,” an illegal numbers game, during his time as vice governor of the province.

Saying he was finally blowing the whistle for fear of his life, Alwin Nimo, a former village and Sangguniang Kabataan chair of Barangay Anislag, accused Lagman of graft, bribery and violations of the Code of Conduct and Ethical Standards for Public Officials and Employees and Republic Act No. 9287 (an Act Increasing the Penalties for Illegal Numbers Game).

In the 35-page complaint, Nimo claimed he served as “bagman” for jueteng operators delivering P60,000 per week to Lagman from August 2019 to June 2022.

Lagman allegedly demanded the “protection money” from jueteng operators when the illegal numbers game proliferated after the small town lottery (STL) was ordered halted in Albay in 2017, Nimo claimed.

Reached for comment, Lagman on Tuesday strongly denied receiving any money from jueteng operators, particularly from Nimo.

Lagman said he never demanded a single centavo from illegal numbers game operators.

“When I assumed the vice governorship, I don’t know of any person connected with illegal numbers game. There is, therefore, absolutely no factual basis for me to have allegedly demanded jueteng money from anyone. Those persons involved don’t even know me,” he said in a phone interview.

Regarding the direct bribery complaint lodged against him, he said that under the law, there should be evidence of him protecting his accuser in exchange for the bribe.

“And what concrete act that’s categorical, tangible to protect the illegal numbers game? I don’t even know who needs to be protected there. So how could he actually accuse me of direct bribery?” he said.

He said the filing of cases against him is purely politically-motivated, adding it was a “badly scripted act to divert the heat from certain big politicians serving in Congress who are under investigation from the Senate for the misuse of billions (of pesos) of public funds.”

Nimo, who claimed he had deep connections with jueteng and STL operators in Albay, has alleged that Lagman “directed (him) to be his conduit … asked (him) to intervene for him and get in touch with the financier of jueteng” in Albay after being elected vice governor in 2019.

The payola was “in exchange for him as vice governor and presiding officer of the Sangguniang Panlalawigan … to look the other way and refrain from using their investigative powers to inquire into the proliferation of jueteng in Albay,” Nimo said.

Among the jueteng financiers, locally known as “bangkero,” identified by Nimo in his affidavit were a late former vice mayor of a Batangas town and another person from Bulacan who had also died.

The payoffs were personally handed to Lagman or his driver at a gas station in Legazpi City until sometime in November 2020, when the then vice governor asked for the money to be deposited into a bank account “to avoid the possibility of being seen receiving bundles of money in public places,” Nimo claimed.

The governor of Albay has been charged with bribery and graft over receiving jueteng payloa.

National Capital Region Police Office (NCRPO) chief, Maj. Gen. Jose Melencio Nartatez Jr., has ordered the dismissal of 10 police officers from the service for their involvement in the alleged unlawful arrest, arbitrary detention, and robbery of four Chinese nationals in a Philippine Offshore Gaming Operators (POGO) establishment in ParaƱaque City in September last year.

Ordered dismissed were Lt. Col. Jolet Guevara, Maj. Jason Quijana, Maj. John Patrick Magsalos, Capt. Sherwin Limbauan, Executive M/Sgt. Arsenio Valle, Cpl. Rexes Claveria, and Staff Sergeants Roy Pioquinto, Mark Democrito, Danilo Desder and Christian Corpuz.

“The following personnel are dismissed from the service effective February 12 for grave misconduct, grave irregularity in the performance of duty, grave neglect of duty, the conduct unbecoming of (a) police officer, less grave misconduct, less grave neglect of duty,” read the order released on Tuesday, a copy of which was obtained by the Philippine News Agency.

10 cops have been dismissed from the service over an illegal arrest and detention.

The Commission on Human Rights (CHR) said it scored a “significant victory” with the conviction of three policemen it charged with torture before the trial court in Koronadal City in South Cotabato.

Police officers Edmer Gerodias, Edwin Habagat, and Allen Candido were found guilty of violation of Republic Act (RA) No. 9745, also known as the Anti-Torture Act of 2009, by the municipal trial court in cities (MTCC).

The CHR said the policemen were sentenced to six months to two years imprisonment each and ordered to pay their victim P5,000 each as temperate damages and P20,000 each as moral damages, and to pay the cost of the suit jointly.

It said that Ernesto Omani was arrested by the policemen on Feb. 3, 2018 for traffic violation and placed in custody.  However, it said, the policemen inflicted physical injury on Omani by kicking his face and body, and striking his arm and leg with a rifle butt.

"The Commission strongly denounces any form of violence, particularly when perpetrated by people who are agents of peace and those in positions of authority. This case is not just a blatant violation of the law but also a direct transgression against the principles of humanity," the CHR said in a statement.

With the conviction of the three policemen, the CHR issued another reminder to all police officers to adhere to the Philippine National Police (PNP) Operational Procedures which states that "no violence or unnecessary force shall be used in making an arrest."

It stressed that law enforcement officers must understand the importance of "proportional and judicious" force, since that is the only way to ensure that justice, human rights, and the rule of law are upheld and respected.

"We remain steadfast in our commitment to protecting the rights of every person, regardless of circumstances. While we recognize the utmost importance of accountability, we believe that the true essence of justice is the fair and humane treatment of all. We shall build a society that protects human rights and enables everyone to live without fear of abuse, torture, or cruelty," the CHR declared. 

3 cops have been convicted of torture.

Vice President Sara Duterte condemned Wednesday the ambush of a government physician in Maguindanao del Sur earlier this month. 

Dr. Sharmaine Barroquillo, who works in the Sultan Kudarat Provincial Hospital, was driving her car in Buluan town when she was attacked by unidentified gunmen on the evening of February 3. Barroquillo survived the attack.

Duterte said the incident reflects the state of security and order in the country. 

(We hope that we do not stop until justice is served to Dr. Barroquillo and those responsible for this are held accountable.)

(Our call is to ensure that responsible government agencies ensure the safety of our citizens against the threat of criminals, terrorists, and other forces that seek to intimidate our people and harm our country.)

After the attack, the wounded Barroquillo managed to drive her car away from the scene of the incident.

Medical responders and personnel from the Bulaan Municipal Police Station brought her to a hospital for treatment. 

“Dr. Shai, at such a young age and with a bright future ahead of her, will have to spend months and perhaps even years to regain and optimize her functional abilities,” the batchmates of Barroquillo and faculty members of the Davao Medical School earlier said. 

They pointed out that instead of working abroad, Barroquillo chose to serve the Bangsamoro Autonomous Region in Muslim Mindanao, where there is one physician to 32,000 people.

“Dr. Sharmaine does not deserve this. Her patients do not deserve this.”

A government doctor has survived an assassination attempt.

THE police are on the lookout for the two suspects in the shooting of a barangay chief in Santa Maria, Bulacan, on Friday evening.

PCol. Relly Arnedo identified the victim as Julian Rosillas, 59, married, and chairman of Barangay Mag-asawang Sapa in Santa Maria, Bulacan.

Two unidentified suspects shot Rosillas in front of the barangay hall, Arnedo said.

Rosillas suffered two gunshot wounds and was immediately rushed to Rogaciano M. Mercado Memorial Hospital for treatment.

Arnedo said the victim is now in stable condition but added that the attending physician has recommended the transfer of Rosillas to Bulacan Medical Center Provincial Hospital.

Police investigation showed that the gun attack took place at around 8:30 p.m. while Rosillas was outside the barangay hall. Two suspects onboard a black motorcycle appeared and one of them shot the victim twice in the abdomen.

The suspects fled after the shooting.

Operatives from the Santa Maria Police Station immediately conducted an investigation and manhunt to find the suspects.

Three soldiers were nabbed and suspected shabu worth P340,000 was seized in a buy-bust operation in Barangay Anupul here on Sunday night, February 4. 

The Philippine Drug Enforcement Agency-Tarlac identified the suspects as Corporal Venancio D. Delmoral, Corporal Juan Carlo G. Feliciano, and Sgt. Modesto D. Rosquero.

PDEA said that the suspects were considered high-value targets due to their active duty status.

Recovered from the suspects were a knot-tied transparent plastic sachet containing more or less 50 grams of shabu worth P340,000, a .45 caliber service firearm with magazine and four bullets, a car, and the marked money.

The operation was conducted with the local police.

The Supreme Court (SC) has ordered the dismissal from the service of three Court of Appeals (CA) employees who tested positive for shabu in 2022.

In full session, SC justices found Garry Caliwan, Edmundo Malit and Frederick Mauricio administratively liable for using illegal drugs under Section 14(o) of Rule 140 of the Rules of Court.

The CA employees tested positive for shabu in a random drug test conducted by the appellate court in 2022.

The CA transmitted the case records to the Judicial Integrity Board (JIB), which recommended to the SC the dismissal of Caliwan, Malit and Mauricio.

Since Mauricio opted for early retirement, the JIB recommended that his benefits be forfeited, except his accrued leave credits, instead of dismissal from the service.

The JIB also proposed that Mauricio be disqualified from holding public office.

The high court agreed with the JIB’s recommendation of dismissal as penalty, considering that it was the second time that the CA employees tested positive for shabu.

Three SC employees who tested positive for shabu for the second time have been dismissed.

The House Committee on Public Order and Safety cited in contempt two high-ranking police officers for their apaprent refusal to tell the truth in relation to the alleged unlawful arrest, arbitrary detention, extortion, and grave coercion of four Chinese nationals last September 2023 in ParaƱaque City.

ACT-CIS Party-list Rep. Erwin Tulfo moved to detain Southern Police District’s (SPD) Brigadier General Roderick Mariano and Colonel Charlie Cabradilla for supposedly lying and showing disrespect to the the committee during its probe on Monday, Feb. 5.

Tulfo called out Mariano for being a “disgrace to the Philippine National Police (PNP), especially to the high-ranking officers”.

“Obvious na obvious na nagsisinungaling ka, obvious na obvious na pinagtatakpan ka,” Tulfo told him to his face.

(It's obvious that you're lying, it's obvious that they’re covering up for you.)

“This investigation is not going anywhere because they’re really lying, we already have witnesses, and they don't want to talk,” the lawmaker added.

“We don’t have a choice, it's like your committee is being insulted, played with, laughed at. Maybe they thought we’re just toddlers here in Congress so we have to teach them a lesson,” he told the panel chaired by Santa Rosa City lone district Rep. Dan Fernandez. 

The House panel cited both Mariano and Cabradilla in contempt. They were slapped with a penalty of 30 days in detention at the House premises.

The two will join six other detained officers who were previously cited in contempt during a committee hearing on Jan. 30.

Originally detained for only 15 days, the detention of the six officers was extended to 30 days or “until such time they reconsider their statements” to the panel.

Fernandez bared that he expected the officers to be freed during Monday's proceedings, but he decided against it after the individuals continued to lie.

“The problem is you continue lying. I would like to release them but the lying persists,” noted Fernandez.

The Supreme Court (SC) has suspended a judge in General Santos City for gross neglect due to a 10-year delay in deciding on a rape case.

In a statement Tuesday, the high court said it imposed a two-year suspension on General Santos City Regional Trial Court Branch 35 Judge Oscar P. Noel Jr. as “a result of gross neglect of duty in his role as Assisting Judge (Justice on Wheels) in Alabel, Sarangani province.”

The Office of the Court Administrator inquired about an administrative complaint alleging a prolonged delay in a criminal case under Noel's jurisdiction since 2010.

Noel clarified that another judge initially presided over the rape charges against a certain Jimmy dela Torre filed on Oct. 30, 2007 and that he only assumed responsibility for it on Feb. 11, 2010, concurrently presiding over three different courts.

The case was heard in Maasim, Sarangani, with the Justice on Wheels (JOW) bus traveling to and from General Santos City once a month.

Noel said infrequent hearings were caused by his high caseload and time constraints, with hearing resets taking two to three months.

The Judicial Integrity Board (JIB) recommended that Noel was guilty of gross neglect of duty and meted him with a PHP250,000 fine. The SC adopted the JIB's findings but modified the penalty to a two-year suspension.

The SC cited invoked Section 15(1), Article VIII of the Constitution, mandating lower courts to decide cases within three months.

“Efficiency and dedication in case disposition were stressed by the SC, highlighting the inevitability of delays to the prejudice of litigants without such qualities. Judges, therefore, must possess a high sense of duty and responsibility in administering justice promptly,” the court said.

Under Rule 140 of the Rules of Court, as amended by AM 21-08-09-SC, the SC categorized the offense as gross neglect of duty in the performance or non-performance of official functions under Section 14(d).

A judge has been suspended for sitting on a rape case for 10 years.

The Philippine Drug Enforcement Agency arrested a barangay kagawad or councilor in a buy-bust operation in this town on Monday, February 5.

The suspect was identified as Jaimes Bernard N. Peralta.

PDEA-Ilocos Director Joel Plaza said confiscated from the suspect were three heat-sealed transparent plastic sachets containing suspected shabu weighing more or less five grams worth P34,000, a cigarette box, a motorcycle, and the buy-bust money.

Peralta faces a case for violation of Section 5 (Sale of Dangerous Drugs) and Section 11 (Possession of Dangerous Drugs), Article II of Republic Act 9165 or the Comprehensive Dangerous Drugs Act of 2002.

The suspect is detained at the PDEA Pangasinan Provincial Office in Urdaneta City, Pangasinan.

The Sandiganbayan on Tuesday convicted for graft and malversation three former officials of the defunct Technology Resource Center (TRC) for greenlighting the disbursement of a former Laguna lawmaker’s “pork barrel” funds worth P10 million for a ghost livelihood project in 2007.

The antigraft court’s Sixth Division sentenced former TRC deputy director general Dennis Cunanan, former program manager Maria Rosalinda Lacsamana and chief accountant Marivic Jover to serve up to eight years in prison for graft, and up to 18 years and eight months for malversation of public funds.

All three were barred for holding public office while their retirement and gratuity benefits were deemed forfeited … On top of this, they were each ordered to pay P9.8 million—equivalent to the misappropriated state funds. They were also ordered to “solidarily refund” to the treasury bureau the same amount, with an interest of 6 percent per annum until fully paid.

The conviction of the three TRC officers was based on the irregular diversion in 2007 of P10 million in public funds from the pork barrel of then Laguna Rep. Danton Bueser to bankroll a livelihood program that turned out to be fictitious.

According to the court, the TRC sent the funds to a bogus nongovernmental organization (NGO), the Aaron Foundation Philippines Inc., without a notarized memorandum of agreement (MOA) against Commission on Audit rules. A MOA was later executed, but only after the funds were released to the NGO. There was also no list of beneficiaries, estimated cost, procedures for implementation and monitoring requirements.

3 former government employees have been convicted of graft.

A policeman assigned to Isabela, Basilan allegedly shot his wife during a heated argument inside their house in Barangay San Jose Gusu here on Saturday, February 3.

Police identified the suspect as Police Staff Sgt. Julius Santillan Ocariza.

Investigation said Ocariza repeatedly fired at his wife, Fredellen, killing her on the spot.

Police recovered three fired cartridge cases and two fired bullets from a 9mm pistol in the crime scene.

Ocariza escaped but was later arrested by the police.

Zamboanga City Police Office Operations Officer Police Major Albert Alfaro denounced the killing in a press conference on Tuesday, February 6.

A cop has killed his wife.

A barangay tanod (village watchman) was shot and killed on Wednesday, Feb. 7, by his younger brother in Lipa City, Batangas province on Wednesday, Feb. 7, police said Thursday.

The Batangas police said in a report that Jason Gangga, 44, was driving his tricycle around 7:30 p.m. with his wife as passenger, along J.P. Laurel Highway in Barangay Balintawak.

Suddenly, Jason’s younger sibling, Jonel, 36, who had been following the couple with his motorcycle, came close to the tricycle and shot his brother using a caliber 357 gun.

The suspect fled after the shooting and left his brother dead on the spot from a fatal gunshot wound on his head. His wife was unhurt in the incident.

The police immediately conducted a hot pursuit operation and captured the suspect in Barangay Bolbok.

The police seized the handgun used in the killing.

Lipa City police said the shooting incident was motivated by an “old grudge” between the two brothers but did not elaborate.

A village watchmen has been assassinated by his brother.

Three workers in the plate-making plant of the Land Transportation Office (LTO) have been arrested for organized theft of license plates, with another suspect still at large.

In a press conference at the LTO headquarters in Quezon City on Friday, LTO–Intelligence and Investigation Division (IID) Chief Renante Melitante said the arrests were made in an operation with the Philippine National Police (PNP) after a report of suspicious activity at the plant in December.

“We immediately informed [LTO Chief, Assistant Secretary Vigor Mendoza II] about what is happening and he gave us a directive to hold an intelligence build-up,” Melitante said

By the first week of January, he said a witness, who is also a worker at the plant, surfaced and expressed willingness to give a testimony, in addition to the closed circuit television (CCTV) camera footage of the suspects.

Based on the directive of Mendoza, we sent a letter to the PNP and to the DILG (Department of the Interior and Local Government) itself for the coordination of the operation,” he said.

The license plates stolen by the suspects were “made-to-order” and had no presence in the LTO system or corresponding documents, while having the same security and authentication features as legitimate plates, making their use ideal for criminals.

After manufacturing these illegal plates, he said the suspects will hide them within the plant, while the mastermind is responsible for bringing them out of the plant.

“Their leader, he was seen on CCTV how it’s done, he’ll hide it in his back then he’ll place them at the box of his motorcycle. And after duty, he’ll bring them home,” Tan said.

The arrests were made on Thursday by members of the Quezon City Police District (QCPD) and the Special Project Group of the DILG, after one of the suspects was spotted taking out some of the stolen license plates.

The three arrested suspects were not identified but were on “job order” status in addition to the alleged mastermind who is still at large.

The mastermind began working at the LTO in 2018, while the arrested suspects have been working at the LTO since 2019 and 2020.

These stolen plates, he said, can be used by criminals in the "doble plaka (double plate)" and "labas casa (outside the dealership)" schemes.

“They can easily change the record or identity of the car so it will be harder for law enforcement to chase these criminals,” he said.

The "doble plaka" scheme involves changing the license plate of a vehicle while the "labas casa" scheme is a scam that targets public school teachers by enticing them to apply for a pre-arranged car loan and will then steal the car once the loan is approved.

Melitante assured that the illegal activities inside the LTO’s plate-making plant will be rooted out.

Meanwhile, QCPD director Brig. Gen. Redrico Maranan said the suspects had been threatening their fellow LTO personnel within the plate-making plant.

He said the suspects are temporarily under the custody of QCPD and will face charges of qualified theft and robbery. 

Three LTO workers have been arrested for stealing "made-to-order" license plates to be used in crimes.

Two individuals were found positive of using illegal drugs during the drug test initiated by the City of Lapu-Lapu Office of Substance Abuse Prevention (CLOSAP) on Wednesday afternoon, January 24, 2024.

Twenty six personnel from the City’s Clearing Team underwent the drug test, after Lapu-Lapu City Mayor Junard “Ahong” Chan called a meeting.

Chan earlier issued a marching order to CLOSAP to conduct a surprise drug tests to all City Hall workers to ensure that their employees were clear from using illegal drugs.

“Mayor Chan want to ensure that all city hall employees are clear from illegal drugs since they carry the name of the city government,” Garry Lao said, executive director of CLOSAP.

Lao said more employees will undergo mandatory and surprise random drug tests throughout the year.

On Monday, January 22, 115 job order employees from the city hall and traffic enforcers from the City Traffic Management System (CTMS) underwent random testing.

Of the 115 tested, three CTMS personnel were allegedly found positive for using methamphetamine hydrochloride, also known as shabu.

Two members of the Lapu-Lapu City cleaning team have tested positive for drugs.

An argument over an absence without leave (AWOL) case resulted in the death of two soldiers in Labrador, Pangasinan on Friday.

Initial report from the Labrador Police Station stated that Technical Sgt. Marianito Bolante, 47, was shot dead by M/Sgt. Henry Malong Quiajado at the latter’s residence in Barangay Uyong.

Quiajado later killed himself during a standoff with responding cops. 

Quiajado also fired at five other collegues who were with Bolante, who died on the spot, while the others were unhurt.

They are members of the First Scout Ranger Regiment-Philippine Army based in Camp Tecson, Barangay Tartaro, San Miguel, Bulacan.

In a phone interview, M/Sgt. Glenn Ancheta, investigator of the Labrador Police, said the police tried for about three hours to convince Quiajado to surrender after he locked himself in his house.

Recovered from the crime scene were one Glock 17 Gen4 9mm, 12 pieces of live ammunition owned by the suspect, 11 fired cartridge cases of caliber 9mm, and one fired cartridge case for 5.56mm.

It was not clear yet what the argument about the AWOL case was all about.

Former mayor Allan Xystus A. Gamilla of Bongabon town in Nueva Ecija has been charged before the Sandiganbayan with two counts of graft in the alleged irregular purchase of a lot in 2020 for the municipality’s cold storage facility.

Gamilla was charged with violations of Section 3(e) and (g) of Republic Act No. 3019, the Anti-Graft and Corrupt Practices Act, before the anti-graft court’ fifth division.

From June 8, 2020 to Dec. 2, 2021, Gamilla reportedly entered into a contract with Jocelyn R. CeƱa for the purchase of a 20,199-square- meter lot at P950 per square meters, but they just agreed on the total amount of P20,000,000.

Government prosecutors said that Gamilla entered into the contract without prior authority from the Sangguniang Bayan of Bongabon. Also, they said that at the time the contract was signed, the Philippine Rural Development iBuild Program placed the prevailing market value at P72.31 per square meters, but Gamilla bought the property at P950 per square meters.

They also said that Gamilla entered into a Conditional Deed of Sale with CeƱa on behalf of the municipality on May 10, 2021 under the condition that the buyer shall pay a full amount of P4,717,200. The buyer shall also pay P15,282,800 to be paid within five years in equal payments of P3,056,560 annually.

Thus, the prosecutors said Bongabon town paid P4,717,200, which caused undue injury to the municipality in the amount of P4,355,700, representing the difference between the market value and the purchase price.

Graft Investigation and Prosecution Officer II Yasmin Soraya A. Masukat recommended Gamilla’s bail at P40,000 each for the two graft charges.

A possible case of adultery awaits a barangay kagawad and his mistress who were caught inside a motel in Mandaue City, on Friday evening, January 26, 2024.

The suspects were identified as Carl Nelson Arnoco, 41 years old, a resident of Tawason, Mandaue City, and Gilda Cadungog Labares, 60 years old, a resident of Barangay Camputhaw, Cebu City.

Arnoco was said to be a barangay kagawad of Brgy. Luz in Cebu City.

Based on the investigation of Mandaue City Police Station 4, the wife of Arnoco personally went  to their station to ask for assistance, after she saw her husband entering a motel on Friday night.

The police immediately responded and found the suspects inside a room in a motel.

The two were arrested and were appraised about their constitutional rights and detained for proper disposition. 

They will most likely be charged with adultery, authorities say.

Two former officials of the Urdaneta City University (UCU) in Pangasinan have been charged with graft before the Sandiganbayan for reportedly offering in 2013 extension classes without approval from the Commission on Higher Education (CHED).

Charged were former UCU president Elizabeth A. Montero and associate professor II Helen F. Dupale, also the then officer-in-charge of the university’s Graduate School in Olongapo City.

Graft Investigation and Prosecution Officer II Juzzelyx B. Sulit alleged that two former university officials violated the requirements in implementing extension class under Section 24 of CHED Memorandum Order No. 40, series of 2008, in relation to Section 65 of the 2008 Manual of Regulations of Private Higher Education (MORPHE) and Section 5.2.5 of CHED MO No. 27 and CHED MO No. 30, both series of 2009.

The indictment alleged that they offered an extension graduate education program in Olangapo City to students on July 24, 2013 and conducted extension classes in the said graduate school extension even without approval of CHED.

The Lapu-Lapu employee who drove away street kids sleeping on the welcome signage of the Mactan Economic Zone 1 was transferred to a different department.

The video of the incident went viral online and gained mixed reactions from netizens. In the video, the employee was seen approaching the kids with a broom hitting the carton they were sleeping on to rouse them from sleep.

Lapu-Lapu City Administrator Atty. Danilo Almendras on Friday, Jan. 26, said that the employee was transferred on Thursday after he got the memorandum.

Almendras said that he was transferred to the City Traffic Management System from the Nerve Center of the City Disaster Risk Reduction Management Office. 

The city administrator said that the employee was called and asked about his side and how he treated the street kids before he was transferred.

Almendras said that according to the employee, he drove his wife to Mepza. He was not on duty at that time because his schedule was from 8 a.m to 5 p.m. but just decided to wear his uniform.

He said that according to his employees, the street kids have been sleeping around that area, asking people for money and throwing their trash everywhere. The City Social Welfare and Development Office also conducted a rescue operation but said they keep coming back.

Despite this, Almendras said that the employee could have just ask them to leave properly.

Mayor Junard Ahong Chan was also not happy with how the street kids were approached. Chan said that he could just ask them politely, rescue them, and bring them to the barangay. 

In this way, the barangay can call their parents and guardians, talk to them to guide their children. Or if they were abandoned, a case of abandonment will be filed against their parents.

A barangay councilor was killed when he was shot at close range by one of the two suspects who pretended to eat at his cafeteria in San Ildelfonso, Bulacan last Saturday.

Acknowledged by P/Brig. Gen. Jose S. Hidalgo Jr., regional director of Police Regional Office 3 (PRO3), the victim Joel Alvaro, 49-years-old, resident and member of Brgy. Lean on the said town.

The report did not mention whether the victim was shot in the head or body by one of the two suspects, both wearing black jackets and hats. The victim was tending to his cafeteria when the suspects arrived and pretended to be customers.

When he got the timing, the gunman pulled out the cal.40 gun and shot the victim.

The police are investigating the motive for the murder to identify the mastermind behind the crime.

A former senior official of a disaster and calamity response outfit of the now defunct Autonomous Region in Muslim Mindanao was killed in an ambush at a busy thoroughfare in Cotabato City on Sunday night.

Engineer Ramil Masukat succumbed to multiple bullet wounds at a hospital where he was brought by emergency responders for treatment

Masukat survived an ambush unscathed on Nov. 27, 2022 at the border of Shariff Aguak and Mamasapano towns in Maguindanao del Sur but his driver then, Alex Manuel, was not as lucky. He died from gunshot wounds in different parts of his body.

Col. Querubin Lugue Manalang Jr., Cotabato City police director, told reporters on Monday morning that Masukat and his driver were attacked at Rabago Street in Barangay Rosary Heights Mother at about 7 p.m. Sunday by gunmen who immediately escaped using a getaway motorcycle.

Masukat was a former directorate staff of the erstwhile ARMM’s Humanitarian Emergency Action and Response Team, or HEART, renamed Rapid Emergency Action on Disaster Incidence-Bangsamoro Autonomous Region in Muslim Mindanao after BARMM’s creation via a plebiscite in January 2019.

The badly wounded Masukat and his companion managed to drive away from the spot where they were attacked and as their vehicle zigzagged through the street, hit several vehicles along the route and stopped at a fuel refilling station close to the Cotabato Police Precinct 2.

The gun attack that resulted in the death of Masukat, who belonged to a large Moro clan in Maguindanao del Sur, was preceded by the January 23 equally brazen murder by two men of a staff of the 80-member BARMM parliament, the 50-year-old Sulaiman Kusain Macabangon, near a mall not too distant from the capitol here of the Bangsamoro region.

A former senior member of the ARMM has been assassinated on the second try.

The Sandiganbayan has denied the motion of former Technology and Livelihood Resource Center (TLRC) deputy director general Dennis L. Cunanan to reconsider his convictions for graft and malversation of public funds.

For graft, Cunanan was sentenced to a prison term ranging from six to 10 years. He was meted out a jail term ranging from 12 to 18 years for malversation and was ordered to indemnity the government of P9.6 million.

Cunanan was one of five individuals found guilty for the misuse of the P9.6 milion Priority Development Assistance Fund (PDAF) of the late Negros Oriental 3rd District Rep. Herminio G. Teves in 2007.

In his motion for reconsideration, Cunanan argued that the crimes of graft and malversation were not proven beyond reasonable doubt. He said that his act of affixing his signature on the disbursement voucher does not consummate the crime charged, since there are other steps that must be taken before the release of the PDAF-drawn funds.

He further argued that he was not part of any conspiracy, and there is no showing that he is a public officer as defined under Article 217 of the Revised Penal Code.

In denying his motion, the Sandiganbayan said: "The aforementioned grounds relied upon by accused Cunanan are not novel. The lengthy discussions on the said motions are essentially the same points raised during the trial which have been thoroughly and assiduously passed upon by the Court in the assailed decision.”

"Taken in such light, accused Cunanan is still liable under an allegation and finding of conspiracy even if we assume that his functions as Deputy Director General of TRC did not relate to custody or control over the subject funds," the anti-graft court said.

The Sandiganbayan has denied the appeal of an ex-TLRC official convicted of graft.

The Ombudsman suspended Mayor Receliste Escolin of President Roxas town, Capiz province, for three months without pay due to misconduct.

Associate Ombudsman Arita Lapitan has issued an order to  Gov. Fredenil Castro to implement Escolin’s suspension.

The order was issued last December but was only made public this week.

Escolin  was suspended following a case filed by former Vice Mayor Alfonso Golero.

Golero accused Escolin last year of grave abuse of authority and grave misconduct.

Escolin allegedly left the province in 2017 without any permission from then Gov. Antonio del Rosario.

Castro has yet to implement the order as his office reportedly has not received a formal copy of the directive.

Escolin has filed a motion for reconsideration before the Ombudsman in Quezon City.

The Ombudsman has suspended the Mayor of President Roxas due to misconduct.

The assistant municipal treasurer of Pagsanjan town in Laguna failed anew in his attempt to convince the Sandiganbayan to reverse his conviction for malversation of public funds amounting to P483,529.31.

Denied was the motion for reconsideration filed by Elizalde G. GabaleƱo who had been convicted by the Laguna regional trial court (RTC) and sentenced to a jail term of four to 11 years, including a fine equivalent to amount he misappropriated.

On Nov. 23, 2023, the Sandiganbayan affirmed the RTC’s decision. GabaleƱo filed a motion for reconsideration which was denied.

He claimed that all the elements of malversation were not present in his case.  He pointed out that the audit reports made by Commission on Audit (COA) auditors are "doubtful," since they merely alleged in their testimonies that they used all available financial records even without stating what particular documents were used during examination.

However, the Sandiganbayan denied his motion. “All things considered, there being no new or additional arguments or compelling reason raised by accused-appellant GabaleƱo to warrant a reconsideration of the assailed decision of the court denying his appeal from the judgment of conviction rendered by the trial court against him, the denial of his motion for reconsideration for lack of merit is in order," the anti-graft court ruled.

The Sandiganbayan has affirmed the conviction of a Laguna town assistant treasurer for malversation of funds.

Argao police have filed murder charge against a retired Army officer who turned himself in hours after he allegedly shot his neighbor in Barangay Gutlang on Sunday afternoon, January 28. 

The suspect was identified as Eugenio Ramos, 58, a retired Philippine Army officer and a resident of the same barangay.

Police Senior Master Sergeant Bienvenido Amil, investigator at the Argao Municipal Police Station, told CDN Digital in a phone interview that they filed the murder charge against Ramos at the Provincial Prosecutor’s Office on Wednesday morning, January 31.

Ramos allegedly shot his neighbor, Honorato Geverola, 66, which lead to the latter’s untimely demise. 

According to Amil, Geverola was standing by the side of the road when Ramos, who was armed with a .45 caliber pistol, approached the latter at around 1 p.m. on Sunday. 

Ramos allegedly shot Geverola once on his back before he fled.

Geverola was already dead when Argao police arrived at the crime scene, Amil said.

He added that a few hours later, Ramos appeared at the Argao Municipal Police Station to surrender. He also turned over the firearm that he used in killing Ramos.

Upon verification, Amil said they learned that the gun was registered under Ramos’ name.

The hand gun was immediately subjected to ballistics examination, he added.

During his surrender, Amil said that Ramos admitted to killing Geverola.  Their investigation showed that Ramos had an earlier argument with Geverola but he would no longer say what caused the argument.

Amil said they now consider personal grudge as the motive behind the deadly shooting.

The retired army officer is currently detained at the custodial facility of the Argao Municipal Police Station.

A 69-year-old chief tanod was arrested after police found unlicensed firearms in his home in Barangay Maslog, Danao City, northern Cebu.

Allan Rom, the chief tanod of the barangay, was found keeping unlicensed firearms in his home that was raided by operatives of the Criminal Investigation and Detection Group (CIDG)-Mandaue City Field Unit shortly before 6 a.m. on Wednesday, January 31.

The raid was based on a search warrant issued by Executive Judge Josefa Pinza-Ramos of the Regional Trial Court Branch 90 in Danao.

Recovered from Rom’s house were a .45 caliber pistol, an Aresca Japanese rifle, and ammunition.

Police Capt. Nigel Sanoy said that prior to the raid, they received reports that the tanod brandished firearms several times that caused fear in the neighborhood.

The raid was part of CIDG’s “Oplan: Paglalansag Omega'' which runs after individuals possessing unlicensed firearms.

A barangay tanod chief has been arrested for possession of loose firearms.
